<strong>College</strong> PoliciesFamily Educational Rightsand Privacy Act <strong>of</strong> 1974Annually, <strong>Saint</strong> Mary’s <strong>College</strong> informs students <strong>of</strong> their rights and obligationsunder the Family Educational Rights and Privacy Act <strong>of</strong> 1974. ThisAct, with which the institution seeks to comply fully, was enacted toprotect the privacy <strong>of</strong> educational records, including but not limited todisciplinary records, to assure the right <strong>of</strong> students to inspect and reviewtheir educational records, to protect student privacy and to provideguidelines for the correction <strong>of</strong> inaccurate or misleading data. A policystatement, which explains in detail the procedures to be used by the<strong>College</strong> for compliance with the provisions <strong>of</strong> the act, is available in theOffice <strong>of</strong> the Registrar and on the <strong>College</strong>’s website.Disabled Student ServicesServices are available to qualified students with temporary or permanentdisabilities including, but not limited to, mobility limitations, endurancedifficulties, visual impairments, hearing impairments, learning disabilities,and any other documented physical, psychological, health or emotionalimpairment and other physical or mental conditions that qualify as a disabilityand which impedes the student’s equal opportunity to participatewith other students at <strong>Saint</strong> Mary’s <strong>College</strong> <strong>of</strong> <strong>California</strong>. The <strong>College</strong>will not tolerate such conduct. Student complaints will be promptlyinvestigated and students determined to have violated the <strong>College</strong>’spolicy prohibiting such conduct will be subject to the imposition <strong>of</strong> discipline,which may include suspension, termination, expulsion, and/or otherappropriate remedial steps. In addition, the <strong>College</strong>’s Student Handbookincludes a statement <strong>of</strong> the <strong>College</strong>’s policy prohibiting sexual assaultand misconduct.Examples <strong>of</strong> sexual harassment:Unwelcomed sexual advances, requests for sexual favors and otherverbal or physical conduct <strong>of</strong> a sexual nature may constitute sexualharassment when:1. Submission to such conduct is made either explicitly or implicitlya term or condition <strong>of</strong> an individual’s educational advancementand benefits;2. Submission to or rejection <strong>of</strong> such conduct by an individual is used asthe basis for academic decisions affecting that individual; or3. Such conduct has the purpose or effect <strong>of</strong> unreasonably interferingwith an individual’s academic performance or creating an intimidating,hostile or <strong>of</strong>fensive, educational or living environment.A full statement <strong>of</strong> the <strong>College</strong> policy and procedures concerning sexualharassment, can be found in the faculty, staff and student handbooks.Deans, directors and department heads are urged to inform students,staff and faculty <strong>of</strong> <strong>Saint</strong> Mary’s <strong>College</strong> policy on sexual harassment andto inform students <strong>of</strong> procedures for bringing and responding to campuscomplaints. At any time, any student may contact the director <strong>of</strong> HumanResources, who has the general responsibility for the implementation<strong>of</strong> these policies, when a student complaint involves a <strong>College</strong> employeeor vendors. A student may contact the dean <strong>of</strong> students if a studentcomplaint involves another student.46
