to leave [have] <strong>with</strong> her all the Lands <strong>of</strong> Cowtoun, Monquichy, Glentoun,<br />

and pendicles, Together <strong>with</strong> seven years rent <strong>of</strong> my Lands <strong>of</strong> Creigie,<br />

in the Parochin<br />

Bridgtoun, Methers, Snadoun, Spittell, and all I possess<br />

<strong>of</strong> Ecclesgreig and Aberluthnot, To whom I do Grant an Tack and<br />

assedation there<strong>of</strong> and the said Helen Burnet, and failing <strong>of</strong> her by death,<br />

to ane <strong>of</strong> the surviving sisters, whom the said Alexander or Robert<br />

<strong>Burnett</strong> his sons shall marry, the entry to be and begine at Whitesunday<br />

or Martinmas immediately after my Death, She or they paying yearly to<br />

my Heirs male or female [ ] half marks <strong>of</strong> dutie yearly<br />

<strong>with</strong> the<br />

payment <strong>of</strong> publick Burdens and Law Expenses, the two part and the<br />

other two Daughters the third part, and if any <strong>of</strong> our Bairns die their<br />

Portion to come to <strong>Leys</strong>, and if they all live and y proportionally the<br />

rest their part <strong>of</strong> her Jointure, And this I do in respect I have long ago<br />

burdened my Heirs female <strong>with</strong> the payment <strong>of</strong> Sixty thousand pounds<br />

to Sir Thomas <strong>Burnett</strong> <strong>of</strong> Leyis In case my Daughter Helen, Agnas or<br />

Jean do refuse to marry the son <strong>of</strong> the said Sir Thomas as said is who<br />

shall be heir to all his father's Estate and Heritage, And In case the heir<br />

<strong>of</strong> the said Sir Thomas at his Age <strong>of</strong> Eighteen years refuse to marry any<br />

<strong>of</strong> my said Daughters, being living eldest son for the time, I declair the<br />

said Bond <strong>of</strong> Sixty thousand pounds null and void In respect it is granted<br />

only upon thir Terms whilk is <strong>of</strong> the Date at Creigie the twenty eight<br />

day <strong>of</strong> November, one thousand six hundred and eighty five years, And<br />

as for my other two Daughters I ordain Agnes to marry Robert <strong>Burnett</strong>,<br />

eldest son to Glenbervie, and Jean to marry Robert Burnet, son to James<br />

Burnet foresaid <strong>of</strong> Kair, at the age <strong>of</strong> Eighteen years or sooner, And if<br />

they refuse to marry the said Robert Burnets <strong>The</strong>n I burthen their<br />

proportion <strong>of</strong> the Lands that shall fall to them by my decease <strong>with</strong><br />

payment <strong>of</strong> Twenty thousand pounds to be paid to Sir Thomas <strong>Burnett</strong><br />

as said is if his heir and son marry rny said eldest daughter living at her<br />

twelve or fourteen years <strong>of</strong> age or sooner, And I leave my said three<br />

Daughters to be educate in Bed, and board and Cloathing and Education<br />

<strong>with</strong> their mother, Helen Arbuthnot, till their age <strong>of</strong> seven years, and<br />

after that to be educate <strong>with</strong> Glenbervy or the Laird <strong>of</strong> Leyes ffor the<br />

whilk I ordain an hundred merks to be paid yearly to my said wife, and<br />

her to maintain them the first Two years for my household and plenishing,<br />

whilk I ordain my Executours to give her, Except Jewells, Silver Work,<br />

and Cabinets, but her to have six silver spoons, and for that Cause also I<br />

ordain her to get five hundred merks <strong>of</strong> money at and <strong>with</strong>in fourteen<br />

days after my Death, and her to gett all my gold to be only keeped by<br />

her and equally distributed to my Daughters at their marriage. Also I<br />

ordain her to gett the House and Inner [maner] place <strong>of</strong> Creigie, <strong>with</strong><br />

the Garden and Inclosures, free there to dwell in ay and while <strong>with</strong>in an<br />

month after she shall marry, and the samen to be prysed at my Death to<br />
