male and assigns] abovesaid, And if it shall have pleased the heirs and successors<br />

<strong>of</strong> the aforesaid Sir Thomas Burnet to be served, returned, empowered and<br />

saisined in the lands and other things aforesaid <strong>with</strong>in the said our realm <strong>of</strong><br />

<strong>Scotland</strong>, then and in that case, We, <strong>with</strong> the advice abovewritten, do will, grant,<br />

declare and ordain that writs to this effect, to be addressed to our sheriff <strong>of</strong> our<br />

sheriffdom <strong>of</strong> Edinburgh and his deputies,<br />

be directed and returned to the<br />

chancery <strong>of</strong> our said realm <strong>of</strong> <strong>Scotland</strong>, and precepts <strong>of</strong> saisihes thereupon to be<br />

addressed to the said our sheriff <strong>of</strong> Edinburgh and his deputies be directed, and<br />

by them be demanded for due execution ; Which returns in deed, precepts, and<br />

saisines, to be in this manner expedited, shall possess such strength, validity,<br />

efficacy and effect in all respects as if the lands and other the things aforesaid lay<br />

<strong>with</strong>in the said our sheriffdom <strong>of</strong> Edinburgh ; the said Sir Thomas Burnet and<br />

his heirs male and assigns yielding therefor yearly to us and our successors to the<br />

said our crown and realm <strong>of</strong> <strong>Scotland</strong> the aforesaid free farm <strong>of</strong> white farm <strong>of</strong> one<br />

penny <strong>of</strong> the usual money <strong>of</strong> the said our realm <strong>of</strong> <strong>Scotland</strong> upon the ground <strong>of</strong><br />

the said lands and barony, or <strong>of</strong> any part there<strong>of</strong>, on the feast <strong>of</strong> the nativity <strong>of</strong><br />

our Lord, by name <strong>of</strong> a white farm, only if it be demanded, for all other dues,<br />

services, questions or demands which could be exacted or required from the same<br />

lands and barony; And by reason <strong>of</strong> the interval and distance <strong>of</strong> the said<br />

boundaries and region <strong>of</strong> Nova Scotia from the aforesaid our ancient realm <strong>of</strong><br />

<strong>Scotland</strong>, and whereas the same region <strong>of</strong> Nova Scotia is still wholly unprovided<br />

<strong>with</strong> tabellions and notaries public, requisite for the authorisation <strong>of</strong> saisines and<br />

instruments respecting the same, and considering, moreover, the great and<br />

manifold inconveniences which may arise by defect <strong>of</strong> due and lawful resumption<br />

<strong>of</strong> saisine or saisines in pursuance <strong>of</strong> this our present charter and other<br />

enfe<strong>of</strong>ments <strong>of</strong> the same lands and barony granted or to be granted to the said<br />

Sir Thomas Burnet and his heirs male and assigns, and whereas the said region<br />

<strong>of</strong> Nova Scotia and the original enfe<strong>of</strong>ment there<strong>of</strong> is held in chief <strong>of</strong> the<br />

aforesaid our ancient realm <strong>of</strong> <strong>Scotland</strong>, and has been newly discovered, explored<br />

and acquired by the said Sir William Alexander, our Lieutenant there<strong>of</strong>, by his<br />

own proper expenses aforesaid, and he indeed is a native <strong>of</strong> the said our realm <strong>of</strong><br />

<strong>Scotland</strong>, and now has been and is to be planted in part by colonists and natives<br />

<strong>of</strong> the same realm, and for that reason has rightly acquired for itself the<br />

name, style and title <strong>of</strong> Nova Scotia, or New <strong>Scotland</strong>, wherefore the same<br />

is a region <strong>of</strong> Nova Scotia and, as it were, deserved to be considered as a part <strong>of</strong><br />

the said our realm <strong>of</strong> <strong>Scotland</strong>, <strong>The</strong>refore We, <strong>with</strong> the advice aforesaid, do<br />

decree, declare and ordain that a single seisin, to be taken at our Castle <strong>of</strong><br />

Edinburgh, as being the most open and eminent part <strong>of</strong> the said our realm <strong>of</strong><br />

<strong>Scotland</strong>, at the choice and option <strong>of</strong> the said<br />
