becaus I am presently resting, and owing sundry great sowmes <strong>of</strong> moneys, all<br />

vpon heritable bands and obligatiounes, binding me and my aires and successours,<br />

the burden <strong>of</strong> the payment <strong>of</strong> all which will fall vpon my airs and successours :<br />

Countswells, and Fill the Cape, the sowme <strong>of</strong> eight thousand merks Scotts money,<br />

as his band beares, <strong>with</strong> on yeers anuall to Witsonday nixt, i m vi c fyftie thrie, Item<br />

to Robert Crushank, bealzie and burges <strong>of</strong> Aberdeen, as his band beares<br />

thousand merks <strong>with</strong> a yeers anuall to the tearme <strong>of</strong> Witsonday nixt, in the said<br />

yeere ; Item to Jhon Jaffery the sowme <strong>of</strong> eighteen hunderth merks according to<br />

his band, togither also <strong>with</strong> a yeers anual to the forsaid Witsonday, in the yeere<br />

abow mentionat; Item to Thomas Burnet <strong>of</strong> Camphel, elder, aught hunderth<br />

merks according to his band, <strong>with</strong> halfe yeers anuall to the forsaid tearme ; Item<br />

to Mr. James Youngson, scoolmaster in Banchory Ternan, seauen hunderth<br />

merks, as his band beares, <strong>with</strong> on yeers anuall, to the said tearme ; Item to a<br />

sonne <strong>of</strong> vnquhill Fyndly Couts in Banchory, as his band beares, an hunderth<br />

and fyftie merks, <strong>with</strong> anuall for halfe a yeere to Witsonday forsaid ;<br />

Georg Gordowne and his bearnes, as the band beares, in my owen possession,<br />

receaued from vnquhill Mr. William Burnet in trust, and albeit I haue the said<br />

Mr. George his authentick and reall discharg <strong>of</strong> the said sowme, yet being all<br />

delyuered to me vnder trust, it were wickedness to defraud him or his bearnes,<br />

but <strong>with</strong>all, to help me and myn to be leall, I haue bound my selfe and forsaids,<br />

in a contract <strong>with</strong> my sonne, Thomas <strong>Burnett</strong> <strong>of</strong> Sauchen (which is <strong>of</strong> the deat,<br />

at Leyis, the fyft <strong>of</strong> March, im vi c fyftie yeers) to releeue the said my sone Thomas<br />

and Bessie <strong>Burnett</strong>, his spouse, and thair aires <strong>of</strong> the said band to Mr. Georg<br />

Gordoun and his bearnes, both <strong>of</strong> principall (which is fouer thousand merks) and<br />

anualls (ther is only halfe yeer resting to Witsonday nixt, abow said) ; Item to my<br />

sonne Thomas <strong>of</strong> Sauchen forsaid, the sowme <strong>of</strong> tuo thousand merks payable at<br />

the nixt tearme immediately efter the ending <strong>of</strong> the Plea <strong>of</strong> Carndayes, either by<br />

law or frendly agriement (as the forsaid contract betuix him and me beares) ;<br />

according to the said contract I am bound to pay to Helen Burnet, daughter to<br />

vnquhill Mr. William Burnet, two thousand merks, the nixt tearme efter her<br />

mariadge, <strong>with</strong> no anuall till that tyme ; Item to my sone, Mr. Robert Burnet,<br />

avocat, the sowme <strong>of</strong> fyu thousand merks the nixt tearme efter my death, and no<br />

anuall till then ; Item to the said Thomas Burnet <strong>of</strong> Sauchen, the sowme <strong>of</strong> ten<br />

thousand merks, and for the anuall rent ther<strong>of</strong>, ay, and whill it be redeemed, the<br />

townes and lands <strong>of</strong> Esly, Mullock and Cowlerholl, as his assedation beares,<br />

which is <strong>of</strong> the deat, at Leyis, the tuenty nyn day <strong>of</strong> October, 1652 ; Item to my
