partis, pendicles, and pertinentis belonging to the saids lands, all lying w l in the<br />

Shirrefdom <strong>of</strong> Kincardin, in the Mearnes, and Parochen <strong>of</strong> Strauchen : And that<br />

for all the dayes, yeers, and tearmes <strong>of</strong> nynteen yeers, and efter the expiring <strong>of</strong><br />

the same, for the space <strong>of</strong> other nynteen yeers, and efter the expiring <strong>of</strong> the same,<br />

for the space <strong>of</strong> other nynteen yeers, and sua forth from nynteen years to nynteen<br />

yeers, ay, and so long as I and my forsaids shall haue any right to the saids lands ;<br />

And if it shall happen me and my forsaids to acquire the right <strong>of</strong> the reversion <strong>of</strong><br />

the saids lands, then, and in that caise, I bind and obledge me and my forsaids,<br />

be thir presentis . . .<br />

And th* at any Witsonday tearme, when the saids lands shall fall to be redeemed<br />

from me and my forsaids, or at any Witsonday tearme, when I and my forsaids<br />

happens to acquire the right <strong>of</strong> the reversion <strong>of</strong> the saids lands, and this tacke<br />

and assedation euer to stand in full vigor and strenth to keepe the said Anna in<br />

reall and actuall possession <strong>of</strong> vplifting the diuties <strong>of</strong> the saids lands, or causing<br />

labour them her selfe, to her best vtility and pr<strong>of</strong>it, till shee be completely payit<br />

by me and my forsaids <strong>of</strong> the forsaid sowme <strong>of</strong> ten thousand merkis, money abow<br />

specifeit. And for the said Anna her more peacible possession <strong>of</strong> the saids lands,<br />

I, the said Sir Thomas, for me and my forsaids, do assigne the said Anna to sicke<br />

right <strong>of</strong> the teythes <strong>of</strong> the saids lands as I and my forsaids haue presently, or shall<br />

happin to acquire at any tyme herefter, to be bruiked and joyced by her so long<br />

as shee doeth possesse the saids lands, shee alwayes releeuing me and my forsaids<br />

<strong>of</strong> the ministers stipentis, and <strong>of</strong> all other augmentationes, present and to come,<br />

and <strong>of</strong> all other impositiones whatsoeuer th l<br />

happen to be imposed on the saids<br />

teythes <strong>of</strong> the saids lands, proportionly and pro rato, and the said Anna to haue<br />

no longer right to the saids teythes <strong>of</strong> the saids lands then shee happens to<br />

possesse the stocke : As lykwayes I ordeen the said Anna to releeue me and my<br />

forsaids <strong>of</strong> all publict diues and burdens whatsoeuer (as sesses, taxationes, leuies<br />

<strong>of</strong> horsses and foot), alswell not nominat as nominat, th* happens to fall on the<br />

saids lands, so long as shee happens to possesse the same, proportionly and pro<br />

rato : Morouer, I, the said Sir Thomas, ordeen for me and my forsaids, and it is<br />

specially prouided, by this present tacke and assedation, th l the said Anna shall<br />

renunce, outquyt, and ouer giue all title, right, clame, and possession shee hath<br />

had, or any way can pretend to haue to the saids lands and teythes <strong>of</strong> the samen<br />

abow written, at any Witsonday tearme herefter whatsoeuer, whensoeuer it shall<br />

please me and my forsaids (vpon fortie dayes lauchfull premunition by a noter<br />

and two witnessis) to pay to the said Anne the said sowme <strong>of</strong> ten thousand<br />

merkis, money forsaid, and this tacke and assedation then to cease, and to be
