DECLARACIÓN DE LIBERACIÓN DE RESPONSABILIDAD CIVIL Y MANIFESTACIÓN DE RIESGO ASUMIDO
En la Ciudad de Guaymas, Municipio del mismo nombre, siendo las ______ horas, con ______, del día __________, del mes de
________________, del año ________, el (la) C._____________________________________, identificándome en este acto con
________________________ folio No. __________, expedida por ________________________________, por mi propia voluntad,
declaro encontrarme en buen estado de salud y no padecer alguna discapacidad psicológica o motriz, manifiesto no estar embarazada (en caso de ser
mujer), no encontrarme bajo la influencia de alguna droga o en estado de ebriedad y que es mi deseo participar en el Programa Interactivo /
Educativo de Convivencia con Delfines, acatando todas las instrucciones y reglas proporcionadas por los instructores dentro de las instalaciones del
delfinario, y que en caso de no cumplir con estas condiciones estoy sujeto (a) a no participar en el Programa. Así mismo, en base a lo dispuesto en el
Articulo 1913 de Código Civil para el Estado de Sonora, manifiesto conocer y asumir los riesgos que implica mi participación en este programa, así
mismo en este acto libero y exonero al DELFINARIO Y A LA COMISION DE ECOLOGIA Y DESARROLLO SUSTENTABLE DEL ESTADO DE
SONORA, así como a sus respectivos empleados de cualquier responsabilidad en caso de sufrir algún accidente, lesión o daño, inclusive la pérdida de
la vida a causa de mi participación en el Programa Interactivo / Educativo de Convivencia con Delfines, el consiste en una sola sesión. Por lo cual con
la firma de esta declaración voluntariamente renuncio a cualquier reclamación o acción que pudiera corresponderme a mí o a mis herederos en contra
del DELFINARIO Y de la COMISION DE ECOLOGIA Y DESARROLLO SUSTENTABLE DEL ESTADO DE SONORA y a sus empleados en relación
a mi participación en el Programa Interactivo / educativo de convivencia con Delfines. Esta declaración se regirá por la controversia o juicio, me someto
expresamente a la jurisdicción de los Tribunales Competentes de la Ciudad de Guaymas, Sonora, con renuncia expresa a cualquier otra jurisdicción.
Cada uno de los participantes certifica que ha leído y entendido esta DECLARACION DE LIBERACION DE RESPONSABILIDAD CIVIL Y
MANIFESTACION DE RIESGO ASUMIDO antes de firmarlo.
Para cualquier participante menor de edad, la firma del padre(s) o tutor legal se hace tanto en nombre del padre(s) o tutor legal como en nombre del
menor de edad, debiendo proporcionar los siguientes datos: nombre del padre o tutor legal _____________________________, domicilio actual
_________________________________, e identificación _____________. Ahora bien cada uno de los participantes acuerda que no se
ha hecho ninguna modificación a esta liberación, oralmente ni por escrito y que este acuerdo expresa precisa y plenamente el entendimiento de cada
uno de los participantes. Si un juzgado declara invalida, nula o que no se pueda hacer cumplir, alguna parte, termino o provisión de este acuerdo, todos
los términos, partes y provisiones restantes permanecerán en toda su vigencia y efecto.
Dentro de los límites permitidos por la ley, acepto RENUNCIAR A RECLAMOS Y LIBERAR DE RESPONSABILIDAD CIVIL al DELFINARIO y a la
COMISION DE ECOLOGIA Y DESARROLLO SUSTENTABLE DEL ESTADO DE SONORA, a sus funcionarios, directores, empleados e instructores
por toda responsabilidad civil que ocurra a consecuencia, o como resultado de daños y perjuicios, aunque sean ocasionados por negligencia de sus
funcionarios, directores, empleados e instructores, en relación de alguna manera con esta actividad. Además acuerdo que LIBERO DE
RESPONSABILIDAD CIVIL al DELFINARIO y a la COMISION DE ECOLGIA Y DESARROLLO SUTENTABLE DEL ESTADO DE SONORA, a sus
funcionarios, a los miembros de su junta directiva, a sus empleados e instructores por todo reclamo, daño lesión o pérdida ocasionados por mi
negligencia durante mi participación en el programa Interactivo / Educativo de Convivencia con Delfines. He leído este documento en su totalidad y libre
y voluntariamente asumo todos los riesgos de daños y perjuicios y teniendo en cuenta dichos riesgos, por lo que acepto participar en el Programa
Interactivo / Educativo de Convivencia con Delfines.
LIABILITY RELEASE AND ASSUMPTION OF RISK DECLARATION

_______________________________________________, By my own free will, I declare that I am in a good state of health, I don't have a
psychological or physical handicap, I am not pregnant, I am not under the influence of any drug nor alcohol and that it is my wish to participate in the
dolphin interactive/educative program, obeying all the instructions and rules given by the trainers within the dolphin facilities, and in case that I don't
follow these rules I am subject of not participating in the program, like wise, base on what is established in the article no. 1913 of the civil code of the
Sonora State. I declare that I know and assume all the risks that my involvement in the program implies; I hereby release DELFINARIO and COMISIÓN
DE ECOLOGÍA y DESARROLLO SUSTENTABLE DEL ESTADO DE SONORA, as well as it's employees of any responsibility in the case that I suffer
any accident, injury or damage, including the loss of life, due to my participation in the dolphin interactive program by signing this statement I voluntary
release, discharge and relinquish any claims or actions or causes of action of mine or of my estate against DELFINARIO and COMISIÓN DE
ECOLOGÍA Y DESARROLLO SUSTENTABLE DEL ESTADO DE SONORA, and its employees regarding my involvement in the dolphin interactive
program The Mexican laws shall rule this declaration. This declaration is ruled by the controversy o judgment, I submit myself to the jurisdiction of the
competent courts of Guaymas, Sonora, and expressly waive any other jurisdiction. Each one of the participants certifies that has read and understood
this LIABYLITY REALESSE AND ASUMPTION OF RISK DECLARATION before signing it.
For each participant underage, the parent(s) signature or legal guardian, having to provide the following information: Tutor / legal guardian
name___________________________, address _________________________, and identification____________________. Now each of the
participants agree that no modification has been done to this agreement, orally nor in writing and this agreement express a precise and plain
understanding of each participant. if a trial declares it invalid or null or nor capable of submitting part of it, the statement or a provision of this
agreement, all the rest of terms, parts or provisions of this agreement will remain in all their effect or force.
Under the limits allowed by law, I agree to RESING CLAIMS AND TO WAIVE CIVIL RESPONSIBILITY to DELFINARIO and COMISION DE
ECOLOGÍA Y DESARROLLO SUSTENTABLE DEL ESTADO DE SONORA, and its government employees, directors, employees, instructors by all
this civil responsibility that happen in consequence, or as a result of damage or injury due to a negligence cause by any government employee,
directors, employees and instructors, some how related to this activity. I agree to RESING CLAIMS AND TO WAIVE CIVIL RESPONSIBILITY to
DELFINARIO and COMISION DE ECOLOGÍA Y DESARROLLO SUSTENTABLE DEL ESTADO DE SONORA, and its government employee, board
of directors, employees and instructors to any claim, damage, injury or lost cause by my negligence in my participation in the dolphin interactive
program. I have read this document in its totality and by my own will I assume all the risks of damages, lost and injuries and knowing this risk, I accept
to participate in the interactive/ educative swim with dolphin program.
