CHAPTER 2 – Prior to Construction Procedures<br />

Listed below are procedures traditionally implemented on public works projects prior to<br />

construction:<br />

Bid documentation<br />

Contract provisions for the payment of the prevailing wages should be documented prior to bid<br />

advertisement to facilitate compliance by the eventual Apparent Low Bidder that is awarded the<br />

contract by the awarding body.<br />

Advertisement for bid/construction contract<br />

The call for bids and the contract or purchase order must contain language appropriate to the<br />

requirements of prevailing wage law as contained in <strong>Labor</strong> Code sections 1771, 1775, 1777.5, 1813<br />

and 1815. The first advertisement date of the project determines the applicable prevailing wages.<br />

Pre-Bid Conference<br />

Contractors will receive information regarding the applicable prevailing wage determination and<br />

predetermined increases prior to bid. The prevailing wage rates are available on the web site of the<br />

Department of Industrial Relations’ Division of <strong>Labor</strong> Statistics and Research (DLSR). If needed,<br />

contractors should also be provided with a hard copy of relevant prevailing wages for each craft<br />

that would be included in the Scope of Work to ensure that bids are cognizant of the required rates<br />

of pay during the life of the project.<br />

Contractor Pre-Qualification<br />

Contractors are to certify qualifications as a responsible bidder, including in the area of prevailing wage<br />

compliance.<br />

Pre-Construction Conference<br />

This meeting is to be held before commencement of the work by contractors and subcontractors with<br />

accepted bids. The LCP representative should be prepared to discuss and answer questions about<br />

requirements and procedures, including record keeping, wage determinations, apprenticeship<br />

requirements and all labor compliance documentation that must be filed to verify compliance with the<br />

prevailing wage requirements of the <strong>Public</strong> Works project. <strong>Labor</strong> code sections 1777.5 and 1777.6<br />

contain the instructions for hiring Apprentices and the ratios to journeymen. A sign-in sheet for<br />

participants who attended and a checklist showing which labor compliance requirements were<br />

discussed shall be completed and kept on file for each conference.<br />
