QUARREL BETWEEN EARL BNZIE AKD MACKINTOSH. 2/5<br />

Oils <strong>of</strong> a rt'conciliation <strong>with</strong> his uncles by submitting himself to <strong>the</strong><br />

house <strong>of</strong> Su<strong>the</strong>rl<strong><strong>an</strong>d</strong>, <strong><strong>an</strong>d</strong> <strong>with</strong> this view he <strong>of</strong>fered to refer all mat-<br />

tiTs in dispute to <strong>the</strong> arbitrament <strong>of</strong> friends, <strong><strong>an</strong>d</strong> to make such satis-<br />

faction for his <strong>of</strong>fences as <strong>the</strong>y might enjoin. As Sir Robert Gordon<br />

still had a kindly feeling towards Mackay, <strong><strong>an</strong>d</strong> as <strong>the</strong> state in which <strong>the</strong><br />

affairs <strong>of</strong> tlie house <strong>of</strong> Su<strong>the</strong>rl<strong><strong>an</strong>d</strong> stood during <strong>the</strong> minority <strong>of</strong> his<br />

nephew, <strong>the</strong> earl, could not conveniently admit <strong>of</strong> following out hostile<br />

measures against Mackay, Sir Uobert embraced Mackay's <strong>of</strong>fer. The<br />

parties, <strong>the</strong>refore, met at Tain, <strong><strong>an</strong>d</strong> matters being discussed in presence<br />

t>f Sir Alex<strong><strong>an</strong>d</strong>er Gordon <strong>of</strong> Xavidale, George Monroe <strong>of</strong> Miliitoun, <strong><strong>an</strong>d</strong><br />

John Jlonroe <strong>of</strong> Leamlair, <strong>the</strong>y adjudged that Sir Donald should send<br />

Angus Mackay <strong>of</strong> Bighouse, <strong><strong>an</strong>d</strong> three gentlemen <strong>of</strong> <strong>the</strong> Slaight-e<strong>an</strong>-<br />

Aberigh, to Dunrobin, <strong>the</strong>re to remain prisoners during Sir Robert's<br />

Badinloch. After settling some o<strong>the</strong>r matters <strong>of</strong> little moment, <strong>the</strong><br />

parties agreed to hold <strong>an</strong>o<strong>the</strong>r meeting for adjusting all remaining ques-<br />

tions, at Elgin, in <strong>the</strong> month <strong>of</strong> Juno <strong>of</strong> <strong>the</strong> following year, sixteen hundred<br />

nald wished to include Gordon <strong>of</strong> Embo <strong><strong>an</strong>d</strong> o<strong>the</strong>rs <strong>of</strong> his friends, in<br />

Su<strong>the</strong>rl<strong><strong>an</strong>d</strong>, in this arr<strong>an</strong>gement; but as <strong>the</strong>y were vassals <strong>of</strong> <strong>the</strong> house<br />

<strong>of</strong> Su<strong>the</strong>rl<strong><strong>an</strong>d</strong>, Sir Robert would not allow Mackay to treat for <strong>the</strong>m.<br />

In <strong>the</strong> month <strong>of</strong> November, sixteen hundred <strong><strong>an</strong>d</strong> eighteen, <strong>the</strong> peace<br />

Mackintosh, chief <strong>of</strong> <strong>the</strong> Cl<strong>an</strong>-Chatt<strong>an</strong>, which arose out <strong>of</strong> <strong>the</strong> following<br />

circumst<strong>an</strong>ces:—When <strong>the</strong> earl went into Lochaber, in <strong>the</strong> year sixteen<br />

hundred <strong><strong>an</strong>d</strong> thirteen, in pursuit <strong>of</strong> <strong>the</strong> Cl<strong>an</strong>-Cameron, he requested<br />

Mackintosh to accomp<strong>an</strong>y him, both on account <strong>of</strong> his being <strong>the</strong> vassal<br />

<strong>of</strong> <strong>the</strong> marquis <strong>of</strong> Huntly, <strong>the</strong> eai'l's fa<strong>the</strong>r, <strong><strong>an</strong>d</strong> also on account <strong>of</strong> <strong>the</strong><br />

<strong>an</strong>cient enmity which had always existed between <strong>the</strong> Cl<strong>an</strong>-Chatt<strong>an</strong> <strong><strong>an</strong>d</strong><br />

Cl<strong>an</strong>-Cameron, in consequence <strong>of</strong> <strong>the</strong> latter keeping forcible possession<br />

<strong>of</strong> certain l<strong><strong>an</strong>d</strong>s belonging to <strong>the</strong> former in Lochaber. To induce<br />

Mackintosh to join him, <strong>the</strong> earl promised to dispossess <strong>the</strong> Cl<strong>an</strong>-Came-<br />

ron <strong>of</strong> <strong>the</strong> l<strong><strong>an</strong>d</strong>s belonging to Mackintosh, <strong><strong>an</strong>d</strong> to restore him to <strong>the</strong><br />

possession <strong>of</strong> <strong>the</strong>m; but, by advice <strong>of</strong> <strong>the</strong> laird <strong>of</strong> Gr<strong>an</strong>t, his fa<strong>the</strong>r-in-<br />

law, who was <strong>an</strong> enemy <strong>of</strong> <strong>the</strong> house <strong>of</strong> Huntly, he declined to accom-<br />

p<strong>an</strong>y <strong>the</strong> earl in his expedition. The earl was greatly displeased at<br />

Mackintosh's refusal, which, afterwards, led to some disputes between<br />

<strong>the</strong>m. A few years after <strong>the</strong> date <strong>of</strong> this expedition, in which <strong>the</strong> earl<br />

subdued <strong>the</strong> Cl<strong>an</strong>-Cameron <strong><strong>an</strong>d</strong> took <strong>the</strong>ir chief prisoner, whom he imprisoned<br />

at Inverness, in <strong>the</strong> year sixteen hundred <strong><strong>an</strong>d</strong> fourteen, Mack-<br />

intosh obtained a commisiion against Mackronald, younger <strong>of</strong> iNIoydart,<br />
