Air pollution control systems including wet fume scrubbers to control acidic or alkaline vapors,<br />

ammonia or oxides of nitrogen, thermal oxidizers to control VOCs and bag houses or other<br />

filters to control particulates will be located at the Project Site as necessary. Bulk chemical<br />

storage may include raw assets or concentrated acid waste. These materials shall be stored in<br />

steel-lined tanks equipped with high level sensors and vented to pollution control systems.<br />

Chemical storage rooms will also be located in facilities to store hazardous chemicals typically<br />

delivered to essential chemical storage and distribution rooms through a dock facility.<br />

Certain areas of the manufacturing process may also rely on bulk chemical delivery systems as<br />

opposed to container (i.e., totes, 55-gallon drums, and bottles) transport and delivery of<br />

chemicals. From the chemical storage rooms, bulk chemicals are pumped to the process areas<br />

through chemically resistant tubing inside clear secondary containment PVC piping. Secondary<br />

containment piping shall be equipped with low point drains and leak detection.<br />

Minimization and Mitigation Measures<br />

A wide variety of environmental and health and safety laws and regulations shall guide the<br />

design, construction, and operation of the advanced technology manufacturing facilities to be<br />

located at the Project Site. All future manufacturing activities to be conducted at the Project<br />

Site shall be subject to the appropriate NYSDEC regulations including those requirements set<br />

forth in the Hazardous Substance Bulk Storage Program (6 N.Y.C.R.R. Parts 595-599) and<br />

Petroleum Bulk Storage Program (6 N.Y.C.R.R. Parts 612-614). In addition, all hazardous<br />

materials transferred to and from the Project Site shall only be transported in Department of<br />

Transportation-approved containers by licensed transporters.<br />

The storage and use of any petroleum and hazardous substances at the Project Site shall be<br />

subject to the federal Spill Prevention Control and Countermeasure (“SPCC”) rules. Facility<br />

system design and daily operations at the Project Site shall also comply with all applicable<br />

Uniform Fire and Building Codes and a site-specific Hazardous Material Management Plan shall<br />

be prepared and submitted to the Town of Alabama Fire Department for approval prior to the<br />

issuance of any Certificates of Occupancy. All employees handling hazardous materials or<br />

wastes will be appropriately trained in accordance with applicable Occupational Safety and<br />

Health Act (OSHA) and Resource Conservation and Recovery Act (RCRA) regulations.<br />

Multiple environmental health and safety programs shall be implemented at the Project Site in<br />

order to comply with the applicable provisions of the Town of Alabama Zoning Law, RCRA, New<br />

York State Department of Labor regulations, the Emergency Planning and Community Right-to-<br />

Know Act, and OSHA regulations.<br />

Hazardous process chemicals shall not be stored at any locations at the Project Site without the<br />

user of such chemicals first providing a Hazardous Materials Inventory Statement to the Town<br />

of Alabama Fire Department and other local emergency services agencies as part of a<br />

comprehensive safety emergency planning effort for the Project. All hazardous materials<br />

management practices and engineering controls for the advanced technology and<br />

manufacturing facilities to be located at the Project Site shall also be managed consistent with<br />
