428 <strong>Act</strong> <strong>2004</strong>-40 LAWS OF PENNSYLVANIA<br />
Section 22. Federal funds. -<br />
(a) <strong>Project</strong>s itemized in this act.—In addition to those funds appropriated<br />
in section 21, all moneys received from the Federal Government for the<br />
projects specifically itemized in this act are also hereby appropriated for<br />
those projects.<br />
(b) <strong>Project</strong>s not requiring itemization.—Department <strong>of</strong> Military and<br />
Veterans Affairs construction projects which are totally federally funded but<br />
which are to be administered by the Department <strong>of</strong> General Services are<br />
hereby authorized.<br />
Section 23. (Reserved)<br />
Section 24. Exemption <strong>of</strong> public improvement projects.<br />
The project itemized in section 5(a)(10)(x) <strong>of</strong> this act shall be exempt<br />
from the first paragraph <strong>of</strong> section 1 <strong>of</strong> the act <strong>of</strong> May 1, 1913 (P.L.155,<br />
No.104), entitled “An act regulating the letting <strong>of</strong> certain contracts for the<br />
erection, construction, and alteration <strong>of</strong> public buildings.” - -<br />
Section 25. Allocation <strong>of</strong> funds.<br />
Whenever as determined by the Department <strong>of</strong> Transportation that the full<br />
estimated financial costs <strong>of</strong> the projects itemized in section 16 <strong>of</strong> this act are<br />
not necessary for the proper design, acquisition or construction <strong>of</strong> such<br />
projects, the excess funds no longer required may be allocated by the<br />
Department <strong>of</strong> Transportation to increase the estimated costs <strong>of</strong> any one or<br />
more <strong>of</strong> the projects specifically itemized in a capital budget.<br />
Section 26. Restriction on expenditure <strong>of</strong> certain funds for the Capitol<br />
Complex.<br />
(a) The new and additional funds provided in section 3(8)(i)(A) and (B)<br />
shall only be disbursed upon written approval as follows:<br />
(1) Finance Building - Chairman and executive director <strong>of</strong> the Capitol<br />
Preservation Committee. -<br />
(2) Forum Building - Chairman and executive director <strong>of</strong> the Capitol<br />
Preservation Committee.<br />
(3) North Office Building - Chief Clerk <strong>of</strong> the Senate and the chairman<br />
and executive director <strong>of</strong> the Capitol Preservation Committee. -<br />
(4) Speaker K. Leroy Irvis Building - Chief Clerk <strong>of</strong> the House <strong>of</strong><br />
Representatives and the chairman and executive director <strong>of</strong> the Capitol<br />
Preservation Committee.<br />
(5) Main Capitol Building - Chief Clerk <strong>of</strong> the Senate, Chief Clerk <strong>of</strong><br />
the House <strong>of</strong> Representatives and the chairman and executive director <strong>of</strong><br />
the Capitol Preservation Committee.<br />
(b) The new and additional funds provided in section 3(8)(i)(F) shall only<br />
be disbursed upon written approval <strong>of</strong> the Chief Clerk <strong>of</strong> the Senate.<br />
(c) The new and additional funds provided in section 3(8)(i)(H) shall<br />
only be disbursed upon written approval <strong>of</strong> the Chief Clerk <strong>of</strong> the House <strong>of</strong><br />
Representatives. -<br />
Section 26.1. conditions and limitations on certain capital projects.<br />
(a) Notwithstanding the provisions <strong>of</strong> section 3(9)(v) <strong>of</strong> the act <strong>of</strong><br />
October 30, 2002 (P.L.891, No.131), known as the <strong>Capital</strong> <strong>Budget</strong> <strong>Project</strong>
