<strong>Itemization</strong> <strong>Act</strong> <strong>of</strong> 200 1-2002, the land acquisition and construction <strong>of</strong> a new<br />

combined readiness center/operations maintenance shop maybeiuAdams or<br />

Franidin County. -<br />

(b) Notwithstanding the provisions <strong>of</strong> section 3(9)(xi) <strong>of</strong> the act <strong>of</strong><br />

October 30, 2002 (P.L.891, No.131), known as the <strong>Capital</strong> <strong>Budget</strong> <strong>Project</strong><br />

<strong>Itemization</strong> <strong>Act</strong> <strong>of</strong> 2001-2002, the land acquisition and construction <strong>of</strong> a new<br />

combined readiness center/operations maintenance shop may be in Erie or<br />

Crawford County.<br />

(c) The authorization and appropriation for the capital projects itemized<br />

in section 3(8)(i)(G) and (H) shall be effective upon completion <strong>of</strong> the design<br />

phase for the capital project authorized in section 3(8)(i)(F). The capital<br />

projects itemized in section 3(8)(i)(G) and (H) shall not be released for<br />

design by the Department <strong>of</strong> General Services or the Office <strong>of</strong> the <strong>Budget</strong><br />

until the project authorized in section 3(8)(i)(F) has been released for<br />

construction. The capital project itemized in section 3(8)(i)(E) shall not be<br />

released for construction by the Department <strong>of</strong> General Services or the Office<br />

<strong>of</strong> the <strong>Budget</strong> unless the project itemized in section 3(8)(i)(F) has been<br />

released for design.<br />

Section 27. Delegation. - -<br />

(a) Notwithstanding any provision <strong>of</strong> law to the contrary, the Department<br />

<strong>of</strong> General Services may- delegate the design and construction <strong>of</strong> the project<br />

contained in section 3(1)(ii)(A) to the University <strong>of</strong> Pennsylvania.<br />

(b) For the public improvement projects specifically itemized in section<br />

3(16), the Department <strong>of</strong> General Services may delegate the authority to<br />

construct, improve, equip, furnish, maintain, acquire or operate such projects<br />

to the Philadelphia Regional Port Authority. Notwithstanding any provision<br />

<strong>of</strong> law to the contrary, the Philadelphia Regional Port Authority, at its<br />

discretion and subsequent to the aforementioned delegation, may contract<br />

with one or more <strong>of</strong> the tenant companies leasing or operating port facilities<br />

at the Port <strong>of</strong> Philadelphia for the purpose <strong>of</strong> constructing, improving,<br />

equipping, furnishing, maintaining, -acquiring or operating the public<br />

improvement projects specifically itemized in section 3(16). Any- project<br />

itemized in section 3(16) delegated to the Philadelphia Regional Port<br />

Authority for which the authority contracts with a tenant company for the<br />

purpose <strong>of</strong> constructing, improving, equipping, furnishing, maintaining,<br />

acquiring or operating the project, shall be exempt from the first paragraph <strong>of</strong><br />

section 1 <strong>of</strong> the act <strong>of</strong> May 1, 1913 (P.L.155, No.104), entitled “An act<br />

regulating the letting <strong>of</strong> certain contracts for the erection, construction, and<br />

alteration <strong>of</strong> public buildings,” and the provisions <strong>of</strong> the act <strong>of</strong>March 3, 1978<br />

(P.L.6, No.3), known as the Steel Products Procurement <strong>Act</strong>, and any<br />

provisions <strong>of</strong> law requiring the bidding <strong>of</strong> projects.<br />

(c) Notwithstanding any provision <strong>of</strong> law to the contrary, the Department<br />

<strong>of</strong> General Services may delegate the design and construction <strong>of</strong> the project<br />

authorized in section 3(8)(ii)(C) to the Pennsylvania Convention Center<br />

Authority. The project authorized in section 3(8)(ii)(C) shall require non-<br />

State participation in an amount determined by the Office <strong>of</strong> the <strong>Budget</strong>.
