Tips for L<strong>and</strong>owners<br />

3. St<strong>and</strong> your ground. Some l<strong>and</strong>men may use intimid<strong>at</strong>ion tactics or thre<strong>at</strong>s to pressure you<br />

4. Put together a list of issues important to you before you begin negoti<strong>at</strong>ing with the l<strong>and</strong>man.<br />

Remember, everything except your name <strong>and</strong> the legal description of the property is<br />

negotiable.<br />

5. At any meeting with a l<strong>and</strong>man, document as much as you can. Take notes, or better yet,<br />

tape record your meetings. Or have someone else sit in as a witness.<br />

6. Underst<strong>and</strong> who it is you are dealing with. Research the oil or gas company’s track record.<br />

Talk with neighbors <strong>and</strong> other l<strong>and</strong>owners who have had to deal with the same company.<br />

Find out, if you can, details of agreements reached between the company <strong>and</strong> other surface<br />

owners (e.g., if they offered to test your neighbor’s well w<strong>at</strong>er, they should do the<br />

same for you).<br />

• The Colorado <strong>Oil</strong> <strong>and</strong> <strong>Gas</strong> Conserv<strong>at</strong>ion Commission (COGCC) maintains a d<strong>at</strong>abase<br />

of incidents <strong>and</strong> complaints. You can look up inform<strong>at</strong>ion on a specific company, e.g.,<br />

how many viol<strong>at</strong>ions they have had, <strong>and</strong> how the company responded to complaints.<br />

Also, the d<strong>at</strong>abase has inform<strong>at</strong>ion on inspections, notices of alleged viol<strong>at</strong>ions, <strong>and</strong><br />

spills. It can be found <strong>at</strong> the COGCC website, under “D<strong>at</strong>abase.” (http://oilgas.st<strong>at</strong>e.co.us/).<br />

There may be similar d<strong>at</strong>abases in other st<strong>at</strong>es. Contact your st<strong>at</strong>e<br />

agencies to find out.<br />

7. Consider signing a lease or negoti<strong>at</strong>ing a Surface Use Agreement (both are discussed<br />

below). If you are going to sign a lease, consider negoti<strong>at</strong>ing the Surface Use Agreement<br />

either before or <strong>at</strong> the same time th<strong>at</strong> you negoti<strong>at</strong>e the lease.<br />

Knowing <strong>Your</strong> L<strong>and</strong>man<br />

You may want to ask your l<strong>and</strong>man if he or she is a certified l<strong>and</strong>man, <strong>and</strong> whether or not he<br />

or she belongs to any professional l<strong>and</strong>men associ<strong>at</strong>ions, the largest one being the American<br />

Associ<strong>at</strong>ion of Professional L<strong>and</strong>men (AAPL). Many of these associ<strong>at</strong>ions have codes of<br />

ethics th<strong>at</strong> l<strong>and</strong>men agree to follow. For example, the AAPL Code of Ethics st<strong>at</strong>e th<strong>at</strong>:<br />

The L<strong>and</strong> Professional, in his dealings with l<strong>and</strong>owners, industry parties, <strong>and</strong> others<br />

outside the industry, shall conduct himself in a manner consistent with fairness <strong>and</strong><br />

honesty, such as to maintain the respect of the public.<br />

If you believe th<strong>at</strong> the l<strong>and</strong> professional has used intimid<strong>at</strong>ion tactics, or has lied to you during<br />

the negoti<strong>at</strong>ions, you should call the l<strong>and</strong>man’s associ<strong>at</strong>ion <strong>and</strong> report the incident. For example,<br />

the AAPL has an Ethics Committee to which you may direct complaints. Their address is:<br />
