Surface Use Agreement Provisions to Consider<br />

Development plan<br />

• Surface owners may want to require from the company an overall development plan showing<br />

the loc<strong>at</strong>ion of wells, roads, pipelines, compressors, w<strong>at</strong>er disposal/discharge, etc.<br />

before development starts, with allowance for changes as development progresses. (See<br />

Vermejo Park Mineral Extraction Agreement below for an example of this type of provision)<br />

W<strong>at</strong>er issues<br />

• Address both w<strong>at</strong>er quality <strong>and</strong> quantity issues.<br />

• Establish damage st<strong>and</strong>ards as part of the agreement. Spell out in the agreement how<br />

much of a change constitutes damage (e.g., if your w<strong>at</strong>er well drops below a certain level<br />

or w<strong>at</strong>er quality declines by a certain amount). Include remedies for wh<strong>at</strong> the company will<br />

do if damages occur (e.g., the company will pay for the successful drilling of a new drinking<br />

w<strong>at</strong>er well).<br />

• Be clear from the opening discussion <strong>and</strong> put into the agreement th<strong>at</strong> if drilling or other<br />

development activities damage a w<strong>at</strong>er well or the l<strong>and</strong>, the company is required to replace<br />

the well <strong>and</strong> repair or compens<strong>at</strong>e for the damages.<br />

• W<strong>at</strong>er well loc<strong>at</strong>ion (make sure your w<strong>at</strong>er wells are registered with the st<strong>at</strong>e engineer, so<br />

th<strong>at</strong> you have proof of loc<strong>at</strong>ion).<br />

• Require the company to g<strong>at</strong>her baseline w<strong>at</strong>er quality <strong>and</strong> quantity d<strong>at</strong>a by a consultant of<br />

your choice PRIOR TO any activities on your property. Require the company to conduct periodic<br />

monitoring of w<strong>at</strong>er quality <strong>and</strong> quantity, to gauge whether the company’s activities are<br />

having an effect on your w<strong>at</strong>er. Make sure w<strong>at</strong>er sampling includes quality <strong>and</strong> quantity of:<br />

domestic well w<strong>at</strong>er, surface w<strong>at</strong>ers, springs, <strong>and</strong> groundw<strong>at</strong>er flows. And require the company<br />

to provide regular reports of the test results.<br />

• Require th<strong>at</strong> the company disclose the quality <strong>and</strong> quantity of the w<strong>at</strong>er from oil <strong>and</strong> gas<br />
