consideration is included as Attachment 1.
2. Appointment of an Integrity Commissioner
At the January 14, 2013 meeting, the following resolution was passed:
13-0114-42 That Council retain an Integrity Commissioner under the
Municipal Act to start an investigation to determine if allegations against
the Council have any grounds.
The information to be considered by the Integrity Commissioner has been filed, and
Council will need to approve a process for soliciting applications for an Integrity
Commissioner, and determine the duties the Integrity Commissioner.
a) Soliciting for applications for an Integrity Commissioner
From the research that I have conducted, most of the Integrity Commissioners fulfil the
role on a part time or as needed basis. In order to expedite the appointment process,
and to take advantage of the experience and expertise that already exists in this field, it
would be advantageous to circulate the RFP to persons who currently serve in the role
of an Integrity Commissioner. The RFP would require the applicant to provide details on
experience in this role, and the process recommended for processing complaints
received.
There is an “ad hoc” Association of Ontario Integrity Commissioners and it is
recommended that the “Requests for Proposals” for the Lambton Shores Integrity
Commissioner be sent to this group of distribution.
b) Duties of the Integrity Commissioner
In order to prepare the RFP, it will be necessary to determine the duties and functions
Council would like the Integrity Commissioner to undertake.
The Municipal Act authorizes the appointment of an Integrity Commissioner in the
following section: (the complete section of the Act that pertains to Integrity
Commissioners is attached as “Attachment 2”)

223.3 (1) Without limiting sections 9, 10 and 11, those sections authorize
the municipality to appoint an Integrity Commissioner who reports to council and
who is responsible for performing in an independent manner the functions
assigned by the municipality with respect to,
(a) the application of the code of conduct for members of council and the
code of conduct for members of local boards or of either of them;
