through a gallery, auction house, or other agent, these persons are jointly liable with the<br />
person transferring the ownership.<br />
(3) The duty of notification mentioned in paragraph (1) of this Article, refers to the<br />
specification of sold originals, information on the vendor and the retail selling price, as well as<br />
to the right of the author to inspect, to the necessary extent, the books or other documents of<br />
liable persons.<br />
(4) Droit de suite may not be waived or assigned during the life of the author, and is not<br />
subject to execution.<br />
Article 36 *<br />
Public lending right<br />
(1) Public lending right is the right to equitable remuneration according to Libraries Act<br />
(Official Gazette of the RS No 87/01), when the original or a copy of a work is made available<br />
for use, for a limited period of time, without direct or indirect economic advantage, and if done<br />
through organisations performing such activity as public service.<br />
(2) The foregoing paragraph shall not apply to the use of:<br />
1. originals or copies of library material in the national library, school and academic libraries<br />
and special libraries;<br />
2. architectural structures;<br />
3. originals or copies of works of applied art and industrial design;<br />
4. originals or copies of works for the purpose of public <strong>com</strong>munication;<br />
5. works, for on-the-spot reference, or for lending among organisations;<br />
6. works, by persons acting within the scope of their employment, if such use is intended<br />
exclusively for the execution of their work related duties.<br />
(3) Lending of originals or copies of <strong>com</strong>puter programs and databases to the public is the<br />
exclusive right of their author.<br />
Article 37<br />
Right to remuneration<br />
(1) The author has a right to equitable remuneration for making a sound or visual fixation, and<br />
for photocopying of his work, done within the scope of private or other internal use, under<br />
Article 50 of this Act.
