Article 88<br />

Presumption of exclusivity of assignment<br />

(1) During the period of validity of the publishing contract, the author may not assign the right<br />

of reproduction and the right of distribution of the work in the same language to a third party,<br />

unless otherwise provided by contract.<br />

(2) The right of reproduction and distribution of newspaper articles may be assigned by the<br />

author simultaneously to several users, unless otherwise provided by contract.<br />

Article 89<br />

Publisher's priority right<br />

(1) The publisher who has acquired the right to publish the work in a book form has, among<br />

equal offerees, the priority right to publish the work in electronic form.<br />

(2) The priority right, mentioned in the foregoing paragraph, shall run for the period of three<br />

years from the agreed upon date of publication of the work. Publisher must give written notice<br />

within 30 days of the acceptance of author's written offer.<br />

Article 90<br />

Improvements of the work<br />

Unless otherwise provided by contract, the publisher shall be required to allow the author to<br />

make improvements or other alterations to his work when new editions are prepared,<br />

provided this does not involve excessive costs to the publisher and does not alter the<br />

character of the work.<br />

Article 91<br />

Destruction of work by force majeure<br />

(1) Where the work is destroyed by force majeure after its delivery to the publisher, the author<br />

is entitled to the remuneration that would have been due to him if the work had been<br />

published.<br />

(2) When a prepared edition is <strong>com</strong>pletely destroyed by force majeure before it was put into<br />

circulation, the publisher is entitled to prepare a new edition, and the author shall have the<br />

right to remuneration only for the destroyed edition.<br />

(3) When a prepared edition is partially destroyed by force majeure before it was put into<br />

circulation, the publisher is entitled to reproduce, without payment of remuneration to the<br />

author, only such number of copies as were destroyed.<br />
