(2) In the case mentioned in the foregoing paragraph, co-authors and authors of contributions<br />

retain the right to remuneration.<br />

Section II<br />

Computer programs<br />

Article 111<br />

Definition<br />

(1) Computer programs, within the meaning of this Act, are programs expressed in any form,<br />

including preparatory design materials for their creation.<br />

(2) Ideas and principles, which underlie any element of a <strong>com</strong>puter program, including those<br />

which underlie its interfaces, are not protected.<br />

(3) Computer programs shall be protected if they are individual works, in the sense that they<br />

are their author's own intellectual creations.<br />

Article 112<br />

Employment and works made for hire<br />

Where a <strong>com</strong>puter program is created by an employee in the execution of his duties or<br />

following the instructions given by his employer, or where it is created by an author under a<br />

contract for a work made for hire, it shall be deemed that the economic rights and other rights<br />

of the author to such program are assigned to the employer or person ordering the work,<br />

exclusively and without limitations, unless otherwise provided by contract.<br />

Article 113<br />

Rights of the author<br />

(1) Unless otherwise provided in Articles 114 and 115 of this Act, the author of a <strong>com</strong>puter<br />

program shall have the exclusive right, in particular:<br />

1. to make permanent or temporary reproductions of a <strong>com</strong>puter program by any means and<br />

in any form, in part or in whole. Insofar as loading, displaying, running, transmission or<br />

storage of the <strong>com</strong>puter program necessitate its reproduction, the author's permission shall<br />

be necessary for such acts;<br />

2. to make translations, adaptations, arrangements and any other alterations of a <strong>com</strong>puter<br />

program and the reproduction of the results thereof, without prejudice to the rights of the<br />

person who alters the program;<br />

3. to distribute the original of the <strong>com</strong>puter program or copies thereof in any form, including its<br />

rental.<br />

(2) The author may assign the rights mentioned in the foregoing paragraph to third persons<br />

also with a license agreement.
