(2) The producer of phonograms shall pay half the remuneration mentioned in the foregoing<br />

paragraph, to the performers whose performances are fixed on the phonograms used, unless<br />

different shares are determined by the contract between the producers of phonograms and<br />

the performers.<br />

(3) For the purposes of this Article, phonograms made available to the public by wire or<br />

wireless means in such a way that members of the public may access them from a place and<br />

at a time individually chosen by them, shall be considered as if they had been published for<br />

<strong>com</strong>mercial purposes.<br />

Article 131<br />

Right to remuneration<br />

The producer of phonograms shall have the right to remuneration for reproduction for private<br />

or other internal use, according to Article 37 (2) of this Act.<br />

Article 132<br />

Term of protection<br />

The rights of the producer of phonograms shall last for 50 years after the fixation is made. If<br />

the phonogram is lawfully published during this period, the rights shall last 50 years from such<br />

first publication. If no such publication has taken place, but the phonogram has during this<br />

period been lawfully <strong>com</strong>municated to the public, the rights shall last 50 years from such first<br />

<strong>com</strong>munication to the public.<br />

Film producer<br />

A film producer is a natural person or a legal entity, that in its own name and on its own, or on<br />

somebody else's account, organizes and manages the production of an audiovisual work or of<br />

a sequence of moving images, and has the responsibility for its <strong>com</strong>pletion.<br />

A film producer shall have the exclusive right:<br />

1. to reproduce his videograms;<br />

2. to distribute his videograms;<br />

3. to rent his videograms;<br />

4. to present his videograms to the public;<br />
