Article 78<br />
Subsequent assignments<br />
(1) An assignee to whom an economic right or other author's right has been assigned, may<br />
not, without the consent of the author, further assign this right to a third party, unless<br />
otherwise provided by contract.<br />
(2) Consent, mentioned in the foregoing paragraph, is not required where subsequent<br />
assignment of the right is effected in consequence of corporate changes, bankruptcy or<br />
liquidation of the assignee.<br />
(3) Where subsequent assignment is allowed without the author's consent either by law or by<br />
contract, the initial and subsequent assignees are jointly liable to the author for his claims.<br />
Article 79<br />
Nullity<br />
Any contractual stipulation shall be considered null and void, if the author undertakes to<br />
assign with it:<br />
1. copyright in its entirety;<br />
2. moral rights;<br />
3. economic rights with respect to all his future works;<br />
4. economic rights with respect to yet unknown means of use of his work.<br />
Article 80<br />
Formality<br />
(1) All assignments of economic rights or other author's rights, and all authorizations must be<br />
in writing, unless otherwise provided by law.<br />
(2) In case of non<strong>com</strong>pliance with the formality, required in the foregoing paragraph, all<br />
controversial or unclear stipulations shall be interpreted in favour of the author.<br />
Article 81<br />
Royalty and remuneration<br />
(1) Where royalty or remuneration was not determined, it shall be determined by taking into<br />
account the usual fees for a particular category of works, the scope and duration of<br />
exploitation, and other circumstances of the case.
