Article 175<br />

Symbols and notices of reserved exclusive rights<br />

(1) Holders of exclusive authors' rights under this Act shall have the right to put a notice on<br />

the original or copies of their works, consisting of the symbol ©, ac<strong>com</strong>panied by their name<br />

or firm name and year date of the first publication.<br />

(2) Holders of exclusive rights to phonograms under this Act, shall have the right to put a<br />

notice on the original or copies of their published phonograms or on their containers,<br />

consisting of the symbol ac<strong>com</strong>panied by their name or firm name and year date of the first<br />

publication.<br />

(3) Until proven otherwise, it shall be presumed that the exclusive rights in works or<br />

phonograms that bear notices mentioned in this Article exist and belong to the person<br />

designated therein.<br />

(4) Provisions of this Article do not affect in any way the existence and protection of rights<br />

under this Act.<br />

Chapter VIII<br />

RELATIONS WITH FOREIGN ELEMENTS<br />

Article 176*<br />

General provision<br />

(1) The provisions of this Act shall protect the authors and holders of related rights who are<br />

citizens of the Republic of Slovenia or a European Union Member State, or have their<br />

residence or seat in the Republic of Slovenia.<br />

(2) Other foreign natural persons or legal entities (foreigners) shall enjoy the same protection<br />

as persons mentioned in the foregoing paragraph if international convention or this Act so<br />

provides, or in case that factual reciprocity exists.<br />

(3) Regardless of the provisions of this Chapter, foreigners shall enjoy the protection<br />

according to this Act:<br />

1. with respect to moral rights - in any case;<br />

2. with respect to droit de suite and the right to remuneration for private and other internal<br />

reproduction - only if factual reciprocity exists.<br />

(4) Reciprocity must be proved by the person basing his claims on it.<br />

(5) Provision of this Act relating to the European Union Member States shall apply also to the<br />

European Economic Area Member States.
