(2) As performers within the meaning of the above paragraph, shall be deemed directors of<br />

theatrical presentations, conductors of orchestras, choir directors, sound editors, and variety<br />

and circus artists.<br />

Article 119<br />

Representative of a group of performers<br />

(1) Performers who collectively take part in a performance, such as members of an orchestra,<br />

choir, dancing troupe, theatrical group or other similar ensemble, shall designate one of their<br />

members to be their representative for the grant of authorizations necessary for the<br />

performance.<br />

(2) To take effect, such power of attorney shall be in writing and shall require the majority<br />

consent of all members of the ensemble.<br />

(3) Provisions of the above two paragraphs shall not apply to conductors, soloists, and<br />

directors of theatrical performances.<br />

Article 120<br />

Moral rights of performers<br />

(1) The exclusive right of performers to have their name or other designation mentioned in<br />

connection with the performance shall be enjoyed:<br />

1. where the performances are given by solo performers - to such performers;<br />

2. where performances are given by ensembles of performers - to such ensemble as a whole,<br />

to the artistic director, and to the soloists.<br />

(2) Performers have the exclusive right to object to any distortion and any other tampering<br />

with respect to their performance, as well as any use of their performance if such tampering<br />

or use could be prejudicial to their person.<br />

Performers shall have the exclusive right:<br />

1. to fix their live performance;<br />

2. to reproduce the phonograms or videograms containing their performance;<br />

3. to publicly transmit their live performance;<br />

4. to broadcast their live performance;
