1. used for goals other than to achieve the interoperability of the independently created<br />

<strong>com</strong>puter program;<br />

2. given to others, except when necessary for the interoperability of the independently created<br />

<strong>com</strong>puter program;<br />

3. used for the development, production or marketing of another <strong>com</strong>puter program<br />

substantially similar in its expression, or for any other act that infringes copyright.<br />

(3) The provisions of this Article may not be interpreted in such way as to allow its application<br />

to be used in a manner that unreasonably prejudices legitimate interests of the author or<br />

conflicts with a normal use of the <strong>com</strong>puter program.<br />

(4) Contractual stipulations contrary to the provision of this Article shall be null and void.<br />

Article 116<br />

Special measures of protection<br />

As infringements of copyright in a <strong>com</strong>puter program shall be deemed the following acts of a<br />

person:<br />

1. any distribution of a copy of a <strong>com</strong>puter program, knowing or having reason to believe, that<br />

it is an infringing copy; or<br />

2. the possession, for <strong>com</strong>mercial purposes, of a copy of a <strong>com</strong>puter program, knowing or<br />

having reason to believe, that it is an infringing copy.<br />

Article 117<br />

Application of other legal provisions<br />

The provisions of this Subsection shall be without prejudice to any other legal provisions on<br />

<strong>com</strong>puter programs, such as those concerning patents, trademarks, unfair <strong>com</strong>petition, trade<br />

secrets, protection of semi-conductor products or the law of contract.<br />

(1) “Performers” are actors, singers, musicians, dancers, and other persons who act, sing,<br />

deliver, declaim, play in, interpret, or otherwise perform copyright works or expressions of<br />

folklore.
