5. to make available to the public the phonograms or videograms containing their<br />

performance;<br />

6. to distribute the phonograms or videograms containing their performance.<br />

7. to rent phonograms or videograms containing their performance.<br />

Article 122<br />

The right to remuneration in case of public <strong>com</strong>munication of a phonogram<br />

A performer shall have the right to participate in the remuneration received by the producer of<br />

a phonogram for public <strong>com</strong>munication of a phonogram in which his performance is fixed.<br />

Article 123<br />

The right to remuneration<br />

The performer shall have the right to remuneration for the reproduction for private or other<br />

internal use, according to Article 37 (2) of this Act.<br />

Article 124<br />

Presumption of assignment<br />

(1) By entering into a contract for the film production, the performer shall be presumed to<br />

have assigned to the film producer, exclusively and without limitations, all economic rights in<br />

his performance, unless otherwise provided by contract.<br />

(2) For each economic right which was assigned according to the foregoing paragraph, the<br />

performer shall retain the right to demand equitable remuneration from the film producer.<br />

(3) A performer cannot waive the right mentioned in the foregoing paragraph.<br />

Article 125<br />

Completion of audiovisual work<br />

When any of the performers refuses to <strong>com</strong>plete his contribution to the audiovisual work or if<br />

he is unable to do so owing to force majeure, he may not object to the use of his contribution<br />

already made for the purpose of <strong>com</strong>pletion of such work. Such performer shall have<br />

respective rights as to the contribution he has already made.<br />

Article 126<br />

Performance given in the course of employment<br />

Where a performance is given by an employee in the execution of his duties or following the<br />

instructions given by his employer (performance in the course of employment), the<br />

relationships with respect to such performance are governed by a collective agreement or<br />

other contract.
