(5) Upon achieving regular full-time employee status, a part-time or a casual employee will<br />

have their hourly seniority converted to a seniority date. The resulting date will be deemed to be<br />

the employee's seniority date.<br />

(6) Regular full-time employees who are returned to either part-time or casual status will<br />

have their seniority converted to hours.<br />

(b) Notwithstanding the above, each Employer, at the time of ratification, excluding those<br />

certifications in Memorandum of <strong>Agreement</strong> #3 (Re: Existing New Certifications, Future Certifications<br />

and Variances) identified as new certifications, will maintain the current system of calculating seniority.<br />

Where an Employer has two or more unions representing employees with different methods of<br />

calculating seniority, the Unions must select a single system within 30 days of ratification of this<br />

<strong>Agreement</strong>. Where they are unable to agree on a single system, the system reference in (a) above will<br />

apply.<br />

Movement Between Agencies<br />

When an employee who was employed by one employer and is subsequently employed by another<br />

employer as a result of a merger , the employee will be credited with seniority in accordance with the<br />

following:<br />

(1) Where the two Employers have a similar method of calculating seniority each employee<br />

moving from one agency to another will be credited with their seniority.<br />

(2) Where the Employers have a different method of calculating seniority, the employee will<br />

have their seniority calculated by their current Employer using the methodology of the new<br />

Employer.<br />

12.2 Seniority List<br />

The Employer will prepare and provide to the Union once every six months an up-to-date seniority list<br />

containing the following information pertaining to its regular employees:<br />

(1) employee's name;<br />

(2) employee's seniority;<br />

(3) employee's current classification;<br />

(4) employee's rate of pay.<br />

This seniority list, except rate of pay, will be posted by the Employer at all worksites for 30 days. Any<br />

objection to the accuracy of the information contained therein must be submitted in writing to the<br />

Employer during the said posting period. Thereafter, the posted list will be deemed to be valid and correct<br />

for all purposes for the duration of that posting period.<br />

The Employer will provide the Union and a union designated employee with a copy of the seniority list<br />

upon request.<br />

12.3 Loss of Seniority<br />

An employee will lose her seniority only in the event that:<br />

(a)<br />

she is discharged for just cause;<br />

(b) subject to Article 12.5 (Bridging of Service), she voluntarily terminates her employment or<br />

abandons her position, as per Article 11.7 (Abandonment of Position);<br />

(c)<br />

she is on layoff for more than one year;<br />

(d) upon being notified by the Employer by priority courier or facsimile at her last known address<br />

that she is recalled from layoff, she fails to contact the Employer with her acceptance of recall within
