MEMORANDUM OF AGREEMENT #1<br />

Re: Local Issues<br />

between<br />

<strong>Community</strong> Social <strong>Services</strong> Employers' Association (CSSEA)<br />

and<br />

<strong>Community</strong> Social <strong>Services</strong> Bargaining Association (CSSBA)<br />

1. CSSEA and CSSBA agree that the following are local issues:<br />

(1) Article 14.2(a) (b)(4), (e), and (f) (Hours of Work);<br />

(2) "Programme" or "Worksite" – as identified in Articles 13.3(a) (Layoff), 14.2(e) (Hours of<br />

Work), 16.4 (Sharing of Overtime), 18.2(a) (Vacation Preferences), 24.1(c) (Job Postings);<br />

(3) Article 30.3 (Casual Call-in Procedure);<br />

(4) Client Vacations and Out of Town Assignments;<br />

(5) School Based or Seasonal Program Employees;<br />

(6) Special Project Employees;<br />

(7) Any other issues agreed to by the Union and CSSEA.<br />

(8) Article 15.4(b) (Split Shifts)<br />

(9) Student employment and work experience programmes: (this item can be incorporated<br />

into the local issues agreements at any time by mutual agreement.<br />

2. Local issues agreements remain in effect until a new agreement is reached.<br />

3. Notice to negotiate local issues must be sent by facsimile or priority courier between December 1,<br />

2011 and December 31, 2011. Negotiation of local issues will be conducted anytime between<br />

January 1, 2012 and 90 days immediately after ratification of the <strong>Collective</strong> <strong>Agreement</strong>.<br />

4. Written notice to bargain local issues will indicate which issue(s) (among those listed in 1 above)<br />

the party wishes to renegotiate. If no notice is given, the current local issue agreement, and/or any<br />

items that are not specified in the notice, will be automatically renewed.<br />

5. Local issues agreements must be approved and signed by CSSEA and the Union.<br />

6. All local issues agreements that are not agreed upon will be referred to Interest Arbitration before<br />

Brian Foley.<br />

Interest Arbitration will be conducted as follows:<br />

(a)<br />

the process will be expedited with no reliance on witnesses;<br />

(b) the presentations will be short and concise and will include a comprehensive<br />

opening statement;<br />

(c) prior to rendering a decision, the Arbitrator may assist the parties in mediating a<br />

resolution to the dispute.<br />

(d)<br />

In rendering a decision, the Arbitrator may consider:<br />

(1) consistency across the sector;<br />

(2) fairness and equitable treatment of employees and Employers in the<br />

sector;
