15.2 Shortfall of Shifts<br />

There will be no pay back for shortfall of annual working hours in the shift systems.<br />

15.3 Short Changeover Premium<br />

(a) Except by mutual agreement, an employee will receive eight consecutive hours off duty when<br />

changing shifts. If shifts are scheduled so that there are not eight hours between the finish of an<br />

employee's shift and the start of her next shift, a premium calculated at overtime rates will be paid for<br />

hours worked on the succeeding shift within the eight hour period.<br />

(b) Where an employee exercises seniority rights to work shifts, one of which falls within the eight<br />

hour period from the finish of the previous shift, the employee will not be entitled to claim the premium<br />

rate referred to in (a) above.<br />

15.4 Split Shifts<br />

(a) Subject to (b) below, it is understood that there will be no regularly scheduled "split shifts" except<br />

in School Age Child Care Programmes or as negotiated between the Union and the Employer at the<br />

local level.<br />

(b) All existing split shift arrangements will be retained as per the previous <strong>Collective</strong> <strong>Agreement</strong><br />

until the expiration of the service contract associated with the arrangement.<br />

The Employer will give the Union sufficient notice of any new/renewed split shifts arrangement in<br />

order to ensure adequate time to discuss the arrangements.<br />

15.5 Work Schedules<br />

(a) Work schedules must be posted 14 calendar days in advance of the beginning of the work<br />

schedule.<br />

(b) Changes to the posted work schedule may only be made for bona fide operational requirements .<br />

(c) With the exception of (d) below, if the change to the employee's schedule is initiated by the<br />

Employer with less than 48 hours' notice, the employee will be paid a premium of 85¢ per hour for<br />

work performed on the first shift of the revised schedule.<br />

(d) The penalty in (c) above does not apply if the change is initiated by the Employer with less<br />

than 48 hours' notice because of an unanticipated absence of a scheduled employee, and no casual<br />

employee is available.<br />

(e) If child care or other serious personal circumstances do not permit such a change, employees may<br />

choose to transfer to casual status. An employee who transfers from regular to casual status will have<br />

their regular sick bank frozen and inaccessible until such time as the employee posts back to regular<br />

status or posts to a vacancy under Article 24.11 (Temporary Vacancies).<br />

16.1 Definitions<br />

"Overtime" means work authorized by the Employer and performed by an employee in excess of:<br />

(1) the scheduled daily hours of a full-time employee;<br />

(2) the maximum daily hours for those employees on flextime; or<br />

(3) the agreed averaging period.<br />

"Straight-time rate" means the hourly rate of remuneration.
