10.3.5 Implementation<br />
Current planning controls<br />
The precinct is currently zoned Farming with a schedule applicable to the precinct that states<br />
that 80 hectares is both the minimum subdivision area and the minimum lot size for which no<br />
permit is required for a dwelling. Small areas of Public Conservation and Resources Zone<br />
are associated with the volcanic lakes.<br />
A number of overlays apply to the precinct:<br />
Environmental Significance Overlay (Schedule 1 – Wetland and associated dryland<br />
habitat protection) in recognition of the wetland and habitat values associated with Lake<br />
Murdeduke, the Barwon River and smaller wetlands.<br />
Land Subject to Inundation and Floodway Overlay for land associated with the Barwon<br />
River, Lake Murdeduke and interspersed wetlands;<br />
The above planning controls are also guided by the <strong>Rural</strong> and Environmental Development<br />
Policy which, in respect of the precinct:<br />
Restricts the development of lots for a dwelling through tenement provisions.<br />
Restricts the excision of an existing dwelling.<br />
The current planning controls are considered appropriate to achieve most of the strategic<br />
directions of the precinct. Consideration should be given to providing further appropriate<br />
protection to all natural resources and to protection of the main landscape elements.<br />
Recommendations<br />
To implement the strategic direction, the following planning controls are recommended:<br />
Retain the Farming Zone and the associated schedule of minimum lot size of 80<br />
hectares.<br />
Retain the <strong>Rural</strong> and Environmental Development Policy but redraft to make the policy<br />
clearer.<br />
Retain the Environmental Significance Overlay (Schedule 1 – Wetland and associated<br />
dryland habitat protection), including a minimum 100 metre buffer either side of the<br />
Barwon River.<br />
Apply the Vegetation Protection Overlay to identified environmental assets, particularly<br />
native grasses (refer Amendment C39).<br />
Consider the incorporation of a policy or strategic statement to guide development within<br />
the preferred landscape setting.<br />
