SOCIAL WELFARE LAW REFORM AND PENSIONS<br />

ACT <strong>2006</strong> (SECTION 39 (in so far as it inserts<br />

section 3B into the Pensions Act 1990) )<br />

(COMMENCEMENT) ORDER, <strong>2006</strong><br />

This Order provides for the commencement <strong>of</strong><br />

section 39 <strong>of</strong> the Social <strong>Welfare</strong> Law Reform <strong>and</strong><br />

Pensions Act <strong>2006</strong>, in so far as it inserts section<br />

3B into the Pensions Act 1990, with effect from 12<br />

April <strong>2006</strong>.<br />

The new section 3B relates to the proceedings<br />

which the Pensions Board may bring for a<br />

summary <strong>of</strong>fence under the Pensions Act <strong>and</strong><br />

provides that certain documentary evidence<br />

submitted in a prosecution is now admissible<br />

without the need for the <strong>of</strong>ficer <strong>of</strong> the Pensions<br />

Board to attend the Court proceedings.<br />

S.I. No. 199 <strong>of</strong> <strong>2006</strong><br />

SOCIAL WELFARE (CONSOLIDATED PAYMENTS<br />

PROVISIONS) (AMENDMENT) (No. 3) (ISLAND<br />

ALLOWANCE) REGULATIONS <strong>2006</strong><br />

These Regulations provide for the addition <strong>of</strong><br />

Fenit Isl<strong>and</strong> in Co. Kerry <strong>and</strong> Isl<strong>and</strong>more in Co.<br />

Mayo to the list <strong>of</strong> prescribed isl<strong>and</strong>s for the<br />

purposes <strong>of</strong> the Isl<strong>and</strong> Allowance payable to<br />

certain <strong>social</strong> welfare recip<strong>ie</strong>nts who are normally<br />

resident on those isl<strong>and</strong>s.<br />

S.I. No. 200 <strong>of</strong> <strong>2006</strong><br />

SOCIAL WELFARE (CONSOLIDATED PAYMENTS<br />

PROVISIONS) (AMENDMENT) (No. 4) (ASSESSMENT<br />

OF MAINTENANCE) REGULATIONS <strong>2006</strong><br />

These Regulations provide for an increase in the<br />

income disregard for those receiving maintenance<br />

from a liable relative. For the purpose <strong>of</strong> deciding<br />

entitlement to a rent or mortgage interest<br />

supplement, the first €95.23 per week <strong>of</strong><br />

maintenance is assessed in full, any maintenance<br />

between €95.23 per week <strong>and</strong> €155.23 per week<br />

is disregarded, with half <strong>of</strong> any maintenance from<br />

€155.23 per week up to a maximum <strong>of</strong> €185.23 per<br />

week also disregarded.<br />

S.I. No. 201 <strong>of</strong> <strong>2006</strong><br />

SOCIAL WELFARE (CONSOLIDATED PAYMENTS<br />

PROVISIONS) (AMENDMENT) (No. 5) (TREATMENT<br />

BENEFIT) REGULATIONS <strong>2006</strong><br />

These Regulations provide for the introduction<br />

<strong>of</strong> an alternative contribution condition for<br />

entitlement to Treatment Benefit. A person over<br />

21 will now be able to avail <strong>of</strong> Treatment Benefit<br />

where he or she has 26 qualifying contributions<br />

in each <strong>of</strong> the second <strong>and</strong> third last contribution<br />

years.<br />

S.I. No. 202 <strong>of</strong> <strong>2006</strong><br />

SOCIAL WELFARE (CONSOLIDATED PAYMENTS<br />

PROVISIONS) (AMENDMENT)(NO. 7) (MATERNITY<br />

AND ADOPTIVE BENEFIT) REGULATIONS <strong>2006</strong><br />

These Regulations provide for a number <strong>of</strong><br />

amendments to the regulations governing<br />

Maternity Benefit <strong>and</strong> extend the period <strong>of</strong><br />

payment <strong>of</strong> Maternity Benefit by 4 weeks,<br />

consequential on the extension <strong>of</strong> paid Maternity<br />

Leave, as announced in Budget <strong>2006</strong>.<br />

The Adoptive Leave Act 2005 amended the<br />

provisions governing Adoptive Leave by providing<br />

that the continuous period <strong>of</strong> Adoptive Leave may<br />

be postponed where the child is hospitalised.<br />

These Regulations allow for Adoptive Benefit to<br />

be postponed in the event <strong>of</strong> the hospitalisation<br />

<strong>of</strong> the child subject to:<br />

• an application to postpone payment being<br />

made in writing, <strong>and</strong><br />

• payment resuming within seven days following<br />

written notification <strong>of</strong> the discharge <strong>of</strong> the child<br />

from hospital.<br />

• Payment will then continue until completion <strong>of</strong><br />

the period <strong>of</strong> entitlement to benefit.<br />
