d) What is the difference between trafficking and prostituti<strong>on</strong>?<br />

Often, trafficking is c<strong>on</strong>fused with prostituti<strong>on</strong>. These are not syn<strong>on</strong>ymous. <strong>Trafficking</strong> is the process /<br />

means while prostituti<strong>on</strong> can be the result/end (of being trafficked).<br />

Meena (refer to pp. 18) was <str<strong>on</strong>g>for</str<strong>on</strong>g>ced into prostituti<strong>on</strong> but she is a trafficked victim. How is that?<br />

Meena was displaced and <str<strong>on</strong>g>for</str<strong>on</strong>g>cibly recruited into commercial sexual exploitati<strong>on</strong> (CSE). While prostituti<strong>on</strong><br />

is a punishable offence when there is commercial sexual exploitati<strong>on</strong> of a pers<strong>on</strong> and any other pers<strong>on</strong><br />

who makes profit from the same [Secti<strong>on</strong> 2(f) of ITPA 1956], trafficking is the whole (or any point of<br />

the) process of recruiting, c<strong>on</strong>tracting, procuring or hiring a pers<strong>on</strong> <str<strong>on</strong>g>for</str<strong>on</strong>g> commercial sexual exploitati<strong>on</strong><br />

(CSE) or <str<strong>on</strong>g>for</str<strong>on</strong>g> any other purpose.<br />

<strong>Trafficking</strong> is there<str<strong>on</strong>g>for</str<strong>on</strong>g>e the overall ‘process’ while prostituti<strong>on</strong>/ commercial sexual exploitati<strong>on</strong>/ <str<strong>on</strong>g>for</str<strong>on</strong>g>ced<br />

labour is the ‘result’.<br />

Thus, Meena has been both trafficked and <str<strong>on</strong>g>for</str<strong>on</strong>g>ced into prostituti<strong>on</strong> as she has been:<br />

- Sexually exploited.<br />

- She has been abused by a pers<strong>on</strong>(s) <str<strong>on</strong>g>for</str<strong>on</strong>g> commercial purposes. Her c<strong>on</strong>sent is irrelevant.<br />

- She is the victim and not a criminal.<br />

It is possible that stereotyped noti<strong>on</strong>s of who c<strong>on</strong>stitutes a victim/ survivor and who a trafficker; who<br />

are more pr<strong>on</strong>e to being trafficked etc exist am<strong>on</strong>g the participants. It is there<str<strong>on</strong>g>for</str<strong>on</strong>g>e, significant that the<br />

participants are not merely able to discuss the varied actors/ pers<strong>on</strong>s in a situati<strong>on</strong> and process of<br />

human trafficking, but are also able to clearly identify them.<br />

As a facilitator you can build clarity <strong>on</strong> these too early <strong>on</strong> in the training.<br />

EXERCISE<br />

Material required : Pre-prepared flash cards<br />

Methodology : Group work<br />

Expected outcome : Participants are able to identify who is a trafficker (offender) and who is a<br />

victim of trafficking (survivor)<br />

1)<br />

Activity<br />

Prepare flash cards prior to the sessi<strong>on</strong>.<br />

2) Write the words depicting a trafficker e.g. transporter, buyer, pimp, financer, parents etc. Choose<br />

some very obvious <strong>on</strong>es like ‘pimp’ but also include words like ‘parent’ to highlight the definiti<strong>on</strong><br />

and its scope.<br />

3) Similarly make flash cards to indicate a trafficked pers<strong>on</strong>.<br />

4) You can make the exercise more interesting by replacing words with pictures or photos.<br />

5) Start by prompting the participants to identify a trafficker and a trafficked pers<strong>on</strong>.<br />

6) Show the flash cards and follow with a discussi<strong>on</strong>.<br />
