Facilitating Change<br />

The Indian C<strong>on</strong>stituti<strong>on</strong> guarantees the equality of each and every citizen be<str<strong>on</strong>g>for</str<strong>on</strong>g>e the law as provided<br />

under Articles 14 and 15 without discriminati<strong>on</strong> <strong>on</strong> the basis of sex. The following articles also provide<br />

respite to individuals specifically related to anti-trafficking:<br />

Article 23 – prohibits the trafficking in human beings<br />

Article 39 – directs the state to ensure that children are not abused and <str<strong>on</strong>g>for</str<strong>on</strong>g>ced due to ec<strong>on</strong>omic<br />

necessity to vocati<strong>on</strong>s unsuited to their age and strength; that children are given opportunities to<br />

develop in a healthy manner and that childhood and youth are protected against exploitati<strong>on</strong>.<br />

Under the Indian Penal Code, a trafficked girl/woman has been subjected to a multitude of violati<strong>on</strong>s.<br />

She has been:<br />

Displaced from the community, which is tantamount to kidnapping/ abducti<strong>on</strong> (Secti<strong>on</strong>s 361,<br />

362, 365, 366 IPC may apply)<br />

Procured illegally (s. 366 A IPC)<br />

Sold by somebody (s. 372 IPC)<br />

Bought by somebody (s. 373 IPC)<br />

Imported from a <str<strong>on</strong>g>for</str<strong>on</strong>g>eign country (if she hails from a <str<strong>on</strong>g>for</str<strong>on</strong>g>eign country, or even from J&K State, and<br />

is under 21 years of age (s. 366 B IPC)<br />

Wr<strong>on</strong>gfully restrained (s. 339 IPC)<br />

Wr<strong>on</strong>gfully c<strong>on</strong>fined (s. 340 IPC)<br />

Physically tortured/injured (s. 327, 329 IPC)<br />

Subjected to criminal <str<strong>on</strong>g>for</str<strong>on</strong>g>ce (s. 350 IPC)<br />

Mentally tortured/harassed/assaulted (s. 351 IPC)<br />

Criminally intimidated (s. 506 IPC)<br />

Outraged of her modesty (s. 354 IPC)<br />

Raped/gang raped/repeatedly raped (s. 375 IPC)<br />

Subjected to perverse sexual exploitati<strong>on</strong> (‘unnatural offences’) (s. 377 IPC)<br />

Defamed (s. 499 IPC)<br />

Subjected to unlawful compulsory labour (s. 374 IPC)<br />

Survivor of criminal c<strong>on</strong>spiracy (s. 120 B IPC)<br />

This list is <strong>on</strong>ly illustrative and not exhaustive. Undoubtedly, in every case, the trafficked pers<strong>on</strong> is a<br />

survivor of at least <strong>on</strong>e or more of the violati<strong>on</strong>s listed above. Oftentimes, in case of CSE the survivors<br />

become pregnant. If they are subjected to miscarriage, then the liability of the offenders falls under the<br />

Secti<strong>on</strong>s 312 to 318 of the IPC. In some cases, the process of exploitati<strong>on</strong> has proven fatal wherein the<br />

survivor succumbs to the direct effects of the harm or the c<strong>on</strong>sequential problems arising thereof. This<br />

means that CSE can also involve the offence of homicide/murder.<br />
