<strong>Brown</strong> <strong>Derby</strong> to act on your behalf in processing and shipping this order, including engaging a common carrier to deliver your order. WINES MAY BE SOLD AND DELIVERED<br />

OLD AND THE PERSON TO WHOM DELIVERY WILL BE MADE IS AT LEAST 21 YEARS OLD. When your alcoholic beverages are delivered, the person receiving delivery<br />

will be required to show identification proving that he or she is at least 21 years old. All sales are subject to applicable Missouri state and any city sales taxes. All wines listed in this<br />

catalog are subject to availability. However, fine wines are not produced on a large scale. Many vintage wines are limited in availability and, when they go out of stock, are usually not<br />

replaceable. New vintages and other similar wines replace those that are no longer available. All of our wines are stored in a climate-controlled environment, and we take great care in<br />

checking the condition of the wine we purchase. However, as is tradition in the wine trade, all bottles over 10 years old, are at the buyer’s risk. Every effort has been made to ensure<br />

accuracy, but in the event of a misprint, the price posted in the store will prevail.<br />

Delivery: We use several ground carriers. For a normal ground shipment, allow 8<br />

to 10 days to receive your order after it has been processed. Ground Rates are<br />

continental U.S. We cannot ship to a Post Office Box. On all residential deliveries,<br />

there will be a $2.00 upcharge. <strong>The</strong> purchaser is responsible for the claim of<br />

damage or loss once the product leaves our premises. Note: Starting July 1st, 2002<br />

all purchases will automatically be charged 1% of the total purchase for insurance.<br />

Please be aware that claims are difficult due to the myriad of alcohol transport<br />

regulations. We reserve the right to hold wine orders up to 90 days before shipping<br />

as a quality control measure. <strong>Wine</strong> can be damaged by temperature extremes.<br />

We will not ship if the temperature in our area is above 75 degrees or below 40<br />

degrees. It is your responsibility to advise us what temperatures are in your area.<br />

We cannot be held responsible if you request shipment and the wines travel in<br />

a climate outside an acceptable temperature range. We will hold and store wine<br />

purchases up to 30 days. After that time a $3.00 per case per month charge will<br />

be automatically assessed. Any cancellations are subject to a 10 percent restocking<br />

penalty. Occasionally, irreplaceable bottles will be broken in shipment or<br />

somehow mishandled in the delivery system to us. In the event any wines do not<br />

arrive, or are damaged in shipment to us, or are damaged by us prior to shipment<br />

to you, we will make every effort to substitute, subject to your approval, wines of<br />

equivalent value. Should we be unable to make an acceptable substitution, we will<br />

then refund your payment together with 5 percent simple interest.<br />
