Assessors will verify that functions are not applicable during the on-siteassessment. The Commission reserves the right to require compliance with anystandard.Standards that are mandatory address life, health, and safety issues; legalmatters; essential law enforcement practices; or conditions that reduce highliability exposure. These standards are denoted by the letter “M” placedimmediately following the standard number. Every agency is required to meet allof these standards except those that are not applicable to the agency’sresponsibilities.If an agency is prevented from complying with an applicable mandatory standarddue to circumstances beyond its control, e.g., labor contracts, court decrees, itmay ask the Commission to “waive” the obligation to comply. The agency mustmake the request in writing during the self-assessment phase using the “WaiverRequest Form” found in Appendix D of this manual. The Executive Director maygrant a conditional approval, if appropriate. Then, during the agency’s on-site,assessors will verify the circumstances prohibiting compliance and documenttheir findings in their final report to the Commission. The Commission will eithergrant a formal waiver or rescind its tentative waiver at the next general meeting.Obtaining a waiver can be a lengthy process, so as soon as the AccreditationManager discovers a problem with a standard, he should call the assignedProgram Manager to discuss it.All remaining standards are “other-than-mandatory” and deal with important ordesirable law enforcement practices. The agency seeking full compliance mayselect any of these standards to satisfy accreditation requirements but mustcomply with at least 80 percent.Phrases and terms that appear in italics denote glossary terms.New or Amended StandardsUnless otherwise directed by the Commission, new or amended standards areeffective upon publication. Agencies seeking initial accreditation, reaccreditation,or having already achieved accreditation or reaccreditation must demonstratecompliance with new or amended standards at their first on-site assessmentsfollowing the publication dates of those standards. However, if those on-siteassessments occur within one year after publication of new or amendedstandards, agencies may delay compliance for up to one year after theenactment dates of those standards.The standards and the accreditation process are constantly under review andevaluation. Each agency self-assessment and on-site assessment byCommission assessors brings the potential for change. This in no way suggeststhat changes occur frivolously. and innovative improvements in law enforcement are welcomed and provisionsfor their inclusion in the state accreditation program are available.Issues concerning the standards or process may surface from several sources,e.g., agency personnel, assessors, staff, Commissioners, or the general public.The Standards Revision Form, Appendix E, which is used to raise standardrelated issues, is sent to staff with a description of the problem and thesuggestion for revision. If feasible, staff will resolve the issue or schedule thematter for action at the next Commission meeting. Copies are also availablefrom CFA staff. The Standards Revision Form is only one means of surfacingissues and does not preclude an individual from raising pertinent issues directlywith the Commission at any of its meetings.15June 2012
