Length of coverage10 years: specifications 263 and 463 on lightweight insulatingconcrete or gypsum, 273 and 473 on precast concrete or steel; 15years: specifications 263 and 463 on wood plank, 264 and 464 onlightweight insulating concrete or gypsum; 20 years: specifications264 and 464 on wood plank, 274 and 474 on poured or precastconcrete or steel, 273 and 473 on poured concrete; 20-yearspecifications are eligible for 15- and 10-year warranties; 15-yearspecifications are eligible for 10-year warranties.10 years 10, 12, 15, or 20 years (length and type of coverage dependsupon specification used).6. Nature of remedy Koppers will undertake repairs as long as the repair isΑpracticable,≅ i.e., the cost of the repair is less than the"remaining value" of the roof on the date the repair is required.ΑRemaining value≅ is the total cost of roof installation reducedby 5 percent for each year or part of a year after the effectivedate with no deduction for the cost of any previous warrantyrepair. If Koppers believes repair is not practicable, payment ofremaining value will be owner's sole and exclusive remedy.7. Monetary limitations Koppers is not liable to pay for a repair that Koppers believeswill cost more than the total cost of the roof installation (BURmembrane, flashing, and Styrofoam) reduced by 5 percent foreach year or part thereof.If manufacturing defects cause the membrane to lose itswatertight integrity, MBT, at its sole discretion and option, willeither refund to the owner a portion of the original purchasecost of the membrane or replace a portion of the membrane.MBT's liability limited to refunding to owner a portion of themembrane's original purchase cost, or replacing a portion ofthe membrane according to a pro-rated schedule, reduced 10percent per year, ranging from 100 percent in years 1 and 2 to10 percent in year 10.Warranty states, Α[r]oofing contractors applying MBT materialsguarantee all workmanship and assume all liability to repair orreplace, at his sole cost and expense, any and all materialscausing leaks wherein the materials were improperly installedfrom the date of warranty issue or until the repairs orreplacement of the MBT materials are proven to provide for areasonable two-year period or [sic] watertight conditions.≅Thereafter, MBT guarantees to repair or replace all defectivematerials to provide for a watertight condition of the roofingsystem. (See Special Features/Conditions.)MBT's liability for repair and/or replacement of defective MBTmembrane shall be restricted to the amount of the original costof MBT material.8. Notification requirementsCall Koppers at 1-800-468-9629 within 72 hours of discovery ofleak or insulation failure and provide written notice byregistered mail to Koppers Industries, Inc., 436 SeventhAvenue, Pittsburgh, PA 15219, Attention: Roofing CustomerService Department.9. Exclusive or additional remedy Remedy provided in warranty is sole and exclusive remedy atlaw or in equity for defects in material supplied by Koppers orDow and workmanship of the contractor. Koppers not liable forconsequential, incidental, or other damages under any theoryof law; excludes UCC warranties.10. Inclusion of consequentialdamagesAll repairs must be authorized in writing in advance bymanager, technical services, MBTechnology, 188 S. TeilmanSt., Fresno, CA 93706-9956.Warranty and remedy provided are exclusive and in lieu of allother obligations, liabilities, or express warranties, excludesUCC warranties. Specifications, descriptive information,recommendations, or test results provided by MBT do notconstitute warranties. In no event shall MBT be liable to ownerin tort, for negligence, strict liability, or otherwise for any loss ordamage resulting from any material defect.No No NoWritten notification by certified mail to MBT's office at 188 S.Teilman, Fresno, CA 93706, within 10 days of the date ownerdiscovers material defect.Warranty and remedy provided are exclusive and in lieu of all otherobligations, liabilities or express warranties; excludes UCCwarranties. No warranties extending beyond warranty document,specifications, descriptive information, recommendations or testresults provided by MBT do not constitute warranties. In no eventshall MBT be liable to owner in tort, for negligence, strict liability, orotherwise for any loss or damage resulting from any materialdefect.632
