Scope of coverageMaterial and workmanship; Siplast warrants that the roof system,comprised solely of the Siplast roof membrane, Siplast roofinsulation, and Zono-tite or NVS fasteners, will remain in awatertight condition. Siplast warrants that the actual resistance toheat flow through the roof insulation will be at least 80% of designthermal resistance provided that the roofing membrane ismaintained free of leaks; if leaks occur, the insulating performanceof the roof insulation will be at least 80% of design thermalresistance within a two-year period following repair of the leak; theroof insulation will remain in a reroofable condition should the roofmembrane require replacement. Damage to the roof insulationcaused by a fastener pull-out during removal of the old membraneis excluded; the roof insulation will not cause structural damage tothe building as a result of its expansion from thermal or chemicalaction. (See Special Features/Conditions.)Material and workmanship; Soprema warrants that theroofing membrane and flashing materials sold by Sopremawill remain in a watertight condition and that the roofingsystem is free from defects in material and installation atthe time of application and that the materials in the roofingsystem conform to Soprema's specifications.Material only; SWEPCO warrants that it will furnish sufficient roofingmaterial to correct any roof leaks that occur in warrantedapplications solely as a result of a proven product defect. SWEPCOdoes not warrant that products will resist the effects of normal agingfor the entire warranty period.5. Nature of remedyIf the roof systems does not remain in a watertight condition,Siplast will repair the roof system at its own expense. If the roofinsulation fails to perform as guaranteed, Siplast shall, at its ownexpense, make or cause to be made repair or modifications to theroof insulation as Siplast deems appropriate so as to enable theroof insulation to perform as guaranteed. Siplast will be liable onlyfor the cost of repair of the roof system by a Siplast approvedcontractor. The expense of removing and replacing traffic surfacesbuilt over the roof shall be borne by owner.Soprema will make repairs necessary to correct leaks inthe roof membrane and flashing at its own expense,including all labor and materials, resulting from defects inmaterial and faulty or improper installation in the roofingsystem or the failure of materials to meet Sopremaspecifications.Replacement material only; SWEPCO will furnish materials requiredto repair leaks. Value of materials calculated at list prices current atthe time of claim; under no circumstances are cash payments made.7. Monetary limitations None stated. None stated.Maximum aggregate value of replacement SWEPCO-brand roofingproducts recoverable over the life of the warranty shall not exceedthe original invoiced price for warranted SWEPCO-brand roofingproducts.8. Notification requirements Written notice within 30 days after leak is discovered orshould by reasonable diligence have been discovered.9. Exclusive or additional remedy The owner's exclusive remedy against Siplast with respectto the roof system; owner waives any and all other claims,actions, and demands relating to roof system; excludes allother guarantees; excludes UCC warranties.Written notification within 30 days after any defect or leak isdiscovered or in the exercise of ordinary care should have beendiscovered to Soprema, Inc. at 310 Quadral Drive, Wadsworth, OH44281.Warranty is sole and exclusive remedy against Soprema; ex-cludesall other warranties; Soprema not liable for special, in-cidental orconsequential damages of any kind, whether arising from breach ofcontract, negligence, breach of warranty or any other legal theoryincluding loss of use of building or equipment, cost of capital, costof substitute equipment, facilities or services, lost profits, downtimecosts, or claims of customers.Owner shall notify SWEPCO promptly and provide writtenconfirmation by registered mail to SWEPCO at P.O.
