Hazardous Waste Regulations<br />
The U.S. Env ronmental Protect on Agency’s<br />
Resource Conservat on and Recovery Act<br />
(RCRA), 23 commonly referred to as the “cradle-tograve”<br />
regulat on, was establ shed to track<br />
chem cals from “cradle,” or generat on, to “grave,”<br />
or d sposal. Th s system mposes requ rements on<br />
both generators and transporters, as well as on<br />
transport, storage, and d sposal fac l t es. RCRA<br />
specifies that once a material is determined to be<br />
hazardous, t becomes the generator’s complete<br />
respons b l ty.<br />
The process for determ n ng whether a mater al s<br />
a hazardous waste should be completed by<br />
qualified personnel. Even new material in its<br />
or g nal conta ner may be cons dered waste f<br />
there s no use for t. The serv ces <strong>of</strong> a hazardous<br />
waste contractor and transporter can be used to<br />
help remove mater als from scenes. Hazardous<br />
mater als that are removed from cr me scenes are<br />
cons dered ev dence and would not fall under<br />
RCRA waste prov s ons. However, when a case<br />
