HIV contracted throughyour workIntensive careLoss of independenceLoss of speechMajor brain injuryMajor burnsMajor organ transplantInfection with Human Immunodeficiency Virus (HIV) as a result of an injury while you are working atyour normal occupation.Any injury that might lead to a claim must be reported to <strong>MLC</strong> within 14 days. The claim must besupported by a negative HIV antibody test on a blood sample taken immediately after the injury.<strong>MLC</strong> must have access to the blood sample tested and must be able to take further samples if<strong>MLC</strong> thinks this is needed.Seroconversion must occur within six months of the injury.A benefit will not be paid if any of the following are true:• the HIV infection has any other cause, including sexual activity or recreational intravenousdrug use• before the injury the Australian Government has recommended an HIV vaccine for use in youroccupation, but you have not taken this vaccine• the Australian Government has approved a treatment which makes HIV inactive andnon-infectious.Mechanical ventilation by means of tracheal intubation for 10 consecutive days (24 hours per day)in an intensive care unit of an acute care hospital.Intensive care as a direct or indirect result of drug or alcohol intake is excluded.As a result of injury or sickness you are permanently unable to do any two or more of the followinggroups of activities of daily living without physical help from someone else:• bathing or showering• dressing• moving from place to place, in and out of bed, and in and out of a chair• eating and drinking• using the toilet.You also lose your independence if you have severe permanent cognitive impairment (with a scoreof 15 or less out of 30 in a Mini Mental State Examination) which leads to a need for continuoussupervision to protect yourself or other people. A Mini Mental State Examination is a test whichsamples various functions including arithmetic, memory and orientation to assess cognition.The loss of independence circumstances must have existed continuously for at least six months.Total and permanent loss of all ability to speak.A claim can only be made once the initial diagnosis is reconfirmed after six months.Physical head injury that results in permanent loss of at least 25% of either the brain’s mentalfunction or its physical control function.Third degree burns to 20% or more of the body surface, or to the whole of the face or the whole ofboth hands requiring surgical debridement and/or grafting.The transplant of any of the following whole organs from a human donor to you:• kidney• lung• liver• pancreas• heart• bone marrow• small bowel.Definitions<strong>MLC</strong> <strong>Life</strong> <strong>Cover</strong> <strong>Super</strong> and <strong>MLC</strong> <strong>Personal</strong> <strong>Protection</strong> <strong>Portfolio</strong> PDS Page 77
