Minutes <strong>of</strong> the deferred Board’s <strong>meeting</strong> held on 2.8.08 in theArbitration room <strong>of</strong> the Supreme Court Bar Association MultiState Cooperative Group Housing Society Ltd. (Regd) at 11.30A.M.Mr. E.C. Agrawala Chairman <strong>of</strong> the Board presided over the <strong>meeting</strong>.1. The Architect Design ‘A’ Mr. Udyan represented the ArchitectDesign ‘A’.The detailed discussions regarding specifications <strong>of</strong> flats & planswere held.It was unanimously decided to invite the members <strong>of</strong> the Societyto attend a <strong>meeting</strong> on 8 th August <strong>2008</strong> to have a look at theplans as submitted by the Architect. The Architect was alsorequested to attend the <strong>meeting</strong>.2. The Board thereafter had a long discussions for laying down auniform policy for considering the disputed cases pertaining to-(a) Default in payment <strong>of</strong> money in time.(b)(c)Eligibility <strong>of</strong> persons to be members <strong>of</strong> the society if they aremembers <strong>of</strong> any other Cooperative Society <strong>of</strong> Lawyers.Eligibility <strong>of</strong> the members who are not resident <strong>of</strong> Delhi/ Haryana/ U.P.3. It was resolved that if there is a default in the payment <strong>of</strong>installment by a member then such member would loose hisseniority and that he will come at the bottom <strong>of</strong> the seniority list<strong>of</strong> paid members even he pays interest @ 15%. The CourtAdministrator had charged 9% interest on the defaulters withoutany basis, though the society is paying 10% interest on principaland further 13% interest in case <strong>of</strong> default to the NoidaAuthority. However in cases where the Bank has made a mistakeor where society has made a mistake unintentionally thenseniority <strong>of</strong> the members will not be disturbed. In cases wherethe bank has committed a mistake then the member has toproduce the requisite certificate and send other documentarypro<strong>of</strong> from the bank.Mr. Ajay Jain, Director dissented on this issue. He was <strong>of</strong> theopinion that all settled issues should not be re-opened orexamined.The majority <strong>of</strong> the Directors were <strong>of</strong> the opinion that thedecision <strong>of</strong> the Court Administrator was contrary to the letter<strong>date</strong>d08.11.2005 issued by Board and circulated to all themembers. Further it was also contrary to the decision taken inthe <strong>meeting</strong> <strong>of</strong> paid members <strong>date</strong>d 08.09.2006. Unfortunately
the Court Administrator further also took decisions contrary tothe order-<strong>date</strong>d 06.10.2005 passed by the Hon’ble High Court <strong>of</strong>Delhi.4. It was also resolved that those members who are not originalallottees <strong>of</strong> the Society’s flats or plots in the SCBA CooperativeSociety and or any other Advocate Cooperative Society would beeligible for a flat in this society, because they was neverbeneficiaries <strong>of</strong> such membership in the society.5. It was also resolved that members who are not resident <strong>of</strong> Delhi/UP/Haryana are not entitled to be benefited <strong>of</strong> the scheme. Mr.Ajay Jain expressed his dissent on the issue <strong>of</strong> residents <strong>of</strong>Chandigarh, as he is <strong>of</strong> the opinion that Chandigarh is Captial <strong>of</strong>Haryana so it is part & parcel <strong>of</strong> State <strong>of</strong> Haryana.Members who are not resident <strong>of</strong> Delhi/ UP/ Haryana must be issuednotices to give pro<strong>of</strong> <strong>of</strong> residence as suggested by Mr. J.N.S Tyagi.This suggestion was accepted.In view <strong>of</strong> the above resolution the Board is <strong>of</strong> the opinion that theGrievance Committee must look into each and every file, so that a finalseniority list can be re-casted. Accordingly this Board approved thatthe Grievance Committee to examine each file and place the reportbefore the Board enabling it to finalize the seniority list.S.C. BHATNAGARC.E.O.
