Sepulveda Dam BasinMaster Plan and Environmental AssessmentEasements for Rights of Way, as amended (10 USC 2688), authorizes the Corps to issueeasements for rights-of-way over, in, and upon Federal land controlled by the Corps when suchuse will not be against the public interest.1.6.2 Executive OrdersExecutive Order (EO)11514, Protection and Enhancement of Environmental Quality, amendedby Executive Order 11991, Relating to Protection and Enhancement of Environmental Quality,mandates that the Federal government provide leadership in protecting and enhancing the qualityof the nation’s environment to sustain and enrich human life. Federal agencies must initiatemeasures needed to direct their policies, plans and programs so as to meet nationalenvironmental goals. CEQ regulations include procedures for early environmental impactstatement (EIS) preparation and require impact statements to be concise, clear, and supported byevidence that agencies have made the necessary analyses.Executive Order 11988, Floodplain Management, outlines the responsibilities of Federalagencies in the role of floodplain management. Federal agencies are required to evaluate thepotential effects of actions on floodplains, and should avoid undertaking actions which directlyor indirectly induce growth in the floodplain or adversely affect natural floodplain values.Construction of structures and amenities in floodplains must consider alternative approaches thatavoid adverse effects and incorporate flood proofing and other accepted flood risk managementmeasures. Agencies shall attach appropriate use restrictions to property proposed for lease,easement, right-of-way, or disposal to non-Federal public or private parties. This EO requiresFederal agencies to provide leadership and take action to: (1) avoid development in the base(100-year) floodplain unless it is the only practicable alternative; (2) reduce the hazards and riskassociated with floods; (3) minimize the impact of floods on human safety, health and welfare;and (4) restore and preserve the natural and beneficial values of the base floodplain.Executive Order 11990, Protection of Wetlands, states that the Federal agencies shall take actionto minimize destruction, loss or degradation of wetlands, and to preserve and enhance the naturaland beneficial values of wetlands in carrying out the agencies responsibilities. Each agency, tothe extent permitted by law, shall avoid undertaking or providing assistance for new constructionlocated in wetlands unless the head of the agency finds (1) that there is no practicable alternativeto such construction, and (2) that the proposed action includes all practicable measures tominimize harm to wetlands which may result from such use. Federal agencies shall also provideopportunity for early public review of any plans or proposals for new construction in wetlands.Executive Order 12088, Federal Compliance with Pollution Control Standards, requires allFederal agencies to ensure that all necessary actions are taken for the prevention, control, andabatement of environmental pollution with respect to Federal amenities and activities undercontrol of the agency.Executive Order 12898, Environmental Justice in Minority Populations and Low-IncomePopulations, requires Federal agencies to identify and address disproportionately high andIntroduction 1-8
adverse impacts of Federal Actions, including Federal licensed actions, programs, policies, oractivities, on minority or low income populations in the United States.Executive Order 13112, Invasive Species, requires Federal agencies to expand and coordinateefforts to prevent the introduction of invasive species and to minimize the economic, ecological,and human health impacts that invasive species may cause.Executive Order 13148, Greening the Government through Leadership in EnvironmentalManagement, mandates that environmental management considerations must be a fundamentaland integral component of Federal Government policies, operations, planning, and management.The primary goal of this EO in the natural resources arena is for each agency to strive to promotethe sustainable management of Federal facility lands through the implementation of costeffective,environmentally sound landscaping practices, and programs to reduce adverse impactsto the natural environment.1,6.3 Corps’ GuidanceThe following paragraphs list Engineer Regulations (ER), Engineer Pamphlets (EP), andEngineer Manuals (EM) published by the Corps that are pertinent for planning, development,and management of the Basin. These Corps documents are cited with their initial publicationdate and updates using a system of changes to specific pages to incorporate modifications to theguidance resulting from new legislation or policy changes. The documents including changes areavailable in digital format at the publications page on the Corps’ Headquarters website athttp://140.194.76.129/publications/.Engineer regulations (ER) establish topic-specific procedural practices that must befollowed at Corps District levels.Engineer pamphlets (EP) provide clarification guidance and/or detailed implementationguidance in support of Federal laws and regulations.Engineer manuals (EM) are documents which provide comprehensive planning and designguidance for a wide range of technical and functional activities.Engineering RegulationsER 200-1-5, Policy for Implementation and Integrated Application of the U.S. Army Corps ofEngineers Environmental Operating Procedures (EOP) and Doctrine, 30 Oct 2003, providesspecific policy and guidance for implementation and the integrated application of the Corps' EOPand associated doctrine across the full spectrum of Corps' program management initiatives andbusiness processes.ER 200-2-2, Environmental Quality: Policy and Procedures of Implementing NEPA, 04 Mar1988, (33 CFR part 230), provides policy and procedural guidance to supplement the Council ofEnvironmental Quality’s final regulations implementing the procedural provisions of the NEPAfor the Civil Works Program of the Corps.Introduction 1-9
