Town of Sharon Zoning LawE. REFERRALS. Notice to Applicant and <strong>Schoharie</strong> <strong>County</strong> Joint Planning Board. Atleast ten (10) days before such hearing, the Joint Planning Board shall mail suchnotices thereof to the applicant and to the <strong>Schoharie</strong> <strong>County</strong> Joint Planning Board asrequired by Section 239-m of the General Municipal Law, which shall beaccompanied by a full statement of such proposed action. The <strong>County</strong> referral shallapply to real property within 500 feet of the following:1. The boundary of any village or town; or2. The boundary of any existing or proposed county or state park or other recreationarea; or3. The right-of-way of any existing or proposed county or state parkway, thruway,expressway, road or highway; or4. The existing or proposed right-of-way of any stream or drainage channel ownedby the county or for which the county has established channel lines; or5. The existing or proposed boundary of any county or state owned land on which apublic building or institution is situated; or6. The boundary of a farm operation located in an agricultural district, as defined byArticle 250aa of the Agriculture and Markets Law.The <strong>Schoharie</strong> <strong>County</strong> Joint Planning Board shall have thirty (30) days to reviewthe full statement of the proposed action. If the <strong>County</strong> Joint Planning Board failsto report within 30 days, the Joint Planning Board may take final action on theproposed action without such report. However, any county Joint Planning Boardreport recommending modification or disapproval of a project and which isreceived after 30 days or such longer period as may have been agreed upon, buttwo or more days prior to final action by the Joint Planning Board, the JointPlanning Board shall not act contrary to such recommendation except by a vote ofa majority plus one of all the members.F. SEQRA. The Joint Planning Board shall comply with the provisions of the NewYork State Environmental Quality Review Act under Article 8 of the EnvironmentalConservation Law and its implementing regulations. An application shall not bedeemed complete until a Negative Declaration has been adopted, or until a draftenvironmental impact statement has been accepted by the lead agency as satisfactorywith respect to scope, content and adequacy.G. OTHER AGENCY REVIEW. In its review, the Joint Planning Board may consultwith professionals such as, but not limited to, an engineer, attorney, surveyor, or landuse/environmental planner and other Town and county officials and boards, as well aswith representatives of federal and state agencies, including the Soil and WaterConservation District, the United States Army Corps of Engineers or the New York73
