Town of Sharon Zoning LawGREENHOUSE (COMMERCIAL): A structure devoted to the protection, orcultivation of tender plants.GROUP CARE FACILITY: A residential facility designed to provide housing and carefor eleven (11) to twenty-five (25) individuals not constituting a family, but living as ahousekeeping unit under the supervision of a resident family operating an approvedprogram regulated by the State of New York or a political subdivision thereof. Suchfacility shall be duly certified by and maintain full compliance with the appropriategoverning social services, mental hygiene or corrections agency under whose auspicesthe program is functioning.HABITABLE SPACE: The space within a dwelling unit occupied for living, sleeping,bathing, eating and cooking purposes and exclusive of a cellar, attic or such otherportions of the dwelling unit not generally occupied by the residents of the dwelling unit.HAZARDOUS MATERIAL: Any waste material within the definition of hazardouswaste found listed in either 40 CFR Part 261, 40 CFR Part 302, 6 NYCRR Part 371 or 6NYCRR Part 597, alone or in combination, including but not limited organic chemicalsolvents, heavy metal sludges, acids with a pH of less than or equal to two, alkalis with apH greater than or equal to twelve point five, radioactive substances, pathological orinfectious wastes or any material exhibiting the characteristics of ingitability, corrosivity,reactivity or EP toxicity.HEAVY INDUSTRIAL USE – Any use or activity which generates, collects, handles,manufactures, transfers, disposes of, or stores significant volumes of smoke, odors, noise,or other polluting wastes and is not compatible with other uses in the district. Examplesof “heavy industry” which are intended to be included in this definition are: chemicalmanufacturing; exploration for crude oil; extraction of crude oil; oil refineries; coalmining; coal processing; and steel manufacturing. It is expressly stated that the foregoingexamples are not intended to be exhaustive and shall not be construed to limit themeaning, scope or application of this definition or to limit the application of thisdefinition solely to the activities identified in the examples.Generic examples of uses not intended to be included in the definition of “heavyindustry” are: milk processing plants; dairy farms; office and communications uses;garment factories; woodworking and cabinet shops; automobile repair shops; wineriesand breweries; warehouses; equipment repair and maintenance facilities; helipads;parking lots and parking garages; light manufacturing or light industrial facilities (asdefined elsewhere in this law); agriculture; and surface gravel and sand mining. It isexpressly stated that the foregoing examples are not intended to be exhaustive shall notbe construed to limit the meaning, scope or application of this definition or to limit theapplication of this definition solely to those activities identified in the examples.HIGH FREQUENCY AND HIGH IMPACT TRUCK TRAFFIC: Traffic over Townroads generated by a commercial project or activity that generates more than ten (10)95
