consumer shall be entitled to withdraw from the contract, in door-to-door sellingas referred to in section 9 and in distance selling as referred to in section 15, asfrom the receipt of the document or the confirmation.(3) If the contract lapses owing to the consumer having invoked its non-bindingness,the business shall without delay and in any event within 30 days of thenotification refund the payments received and compensate the consumer for thecosts of returning the goods or other performances.Section 21 has been repealed.Section 22 has been repealed.Section 23 — Responsibility for delivered performances and compensation for benefitaccrued (1072/2000)(1) If the consumer has received goods or other returnable performances, he/sheshall keep the goods or performances in an essentially unaltered andundiminished condition in order to retain the right of withdrawal.(2) The destruction, spoiling or diminishing of the goods or performances through nofault of the consumer shall not preclude the right to withdraw. The consumershall not be responsible for any reduction in value ensuing from the opening of apackage, the inspection of the goods or performances or a comparable reason.(3) If, at the withdrawal from or lapse of a contract, the consumer gains the benefitof a non-returnable performance, he/she shall compensate the business for thesame with a reasonable amount.Section 24 — Termination of a credit agreement (1072/2000)If, for the conclusion of a contract in door-to-door selling or distance selling, theconsumer has been extended credit by the seller, the service provider or anothercredit provider on the basis of a contract with the seller or the service provider orof another consumer credit scheme, the credit arrangement shall be terminatedwhen the consumer withdraws from the main door-to-door selling or distanceselling contract. The credit agreement shall likewise be terminated if the contractlapses by virtue of section 20. Upon the termination of the credit agreement, thecreditor shall without delay and in any event within 30 days of being informed ofthe withdrawal from or lapse of the main contract refund the payments made bythe consumer.30
