Section 3 — Mandatory provisionsA contract term derogating from the provisions of this chapter to the detriment ofthe consumer shall be void.Section 4 — Definitions(1) For the purposes of this chapter, distance selling means the provision of financialservices to the consumer with the aid of a distance sales-provision scheme runby a business in which the conclusion of a contract and the preceding marketingeffort are carried out exclusively through one or more means of distancecommunication.(2) Distance offering is defined as a method of marketing or selling so arranged thatits primary purpose may be deemed to be the conclusion of contracts through ameans of distance communication.(3) Means of distance communication is defined as telephones, postal services,televisions, information networks or other instruments which may be used toconclude contracts without the simultaneous physical presence of the parties.Section 5 — Obligation to provide information prior to the conclusion of a contractIn addition to the provisions to provide information laid down elsewhere in thelaw, the consumer shall be supplied in good time prior to the conclusion of thecontract with information referred to in sections 6—9 concerning the business,the financial services that are to be provided, the distance selling contract andthe means of redress mechanisms available to the consumer. The informationshall be supplied in a manner suitable for the means of distance communicationused, clearly, comprehensibly and in a manner that makes clear the commercialpurpose of the information.Section 6 — Prior information concerning the businessAt least the following information concerning the business shall be supplied:(1) the name and main business, the geographical address in the state ofestablishment as well as the geographical address of the premises wherecustomer relations are handled;(2) the possible branch office or other representative in the consumer’s countryof residence and the geographical address of the branch office or representativewhere customer relations are handled;32
