(1547/2001)Section 11 has been repealed.Section 12 (8/1989)(1) The National Board of Trade may be authorised, by Decree, to grant, for specialreasons, dispensations from the provisions of the Decree issued under section 6on the quotation of the price of a consumer good or service in marketing.(2) The National Board of Trade may be authorised, by Decree, to issue orders on thequotation of the unit price of a consumer good or of a group of consumer goodsin marketing.Section 13 has been repealed.Chapter 3 — Regulation of contract termsSection 1(1) A business offering consumer goods or services shall not make use of a contractterm which, considering the price of the good or service and the other relevantcircumstances, is to be deemed unfair from the point of view of consumers.(2) If an association of businesses draws up contract terms for contracts relating toconsumer goods or services or issues recommendations or instructions on theterms and conditions to be used, the association shall ensure that its conductdoes not result in the use of terms that are unfair from the point of view ofconsumers. Section 2(1) Where necessary in respect of consumer protection, a business may be enjoinedfrom continuing the use of a contract term contrary to section 1(1) or repeatingthe use of such a term or a comparable term. An association of businesses maycorrespondingly be enjoined from continuing or repeating conduct contrary tosection 1(2). The injunction shall be reinforced by the threat of a fine unless thisis for a specific reason deemed unnecessary. (1259/1994)(2) Should there be special cause, the injunction may also be directed against anemployee of a business referred to in paragraph (1) or against a person acting onits behalf.Section 3(1) An injunction referred to in section 2 shall be issued by the Market Court. TheMarket Court may also issue an interim injunction, in which case the injunctionshall remain in force until the case has been finally decided.
