Section 9 — Failure to observe the provisions on the form, language or contents of thecontract (1162/1997)(1) A contract that does not meet the requirements provided in sections 6—8 shallnot be binding on the buyer. However, if the buyer wishes to invoke the nonbindingnessof the contract because of a lack of information referred to in section7 or 8, he/she shall notify the seller of the same at the latest in three monthsand ten days from the date when the contract has been signed by both parties.(2) If the seller rectifies the contract so that it meets the requirements before thebuyer has invoked the non-bindingness, the buyer shall have the right ofwithdrawal referred to in section 10 as from the date when he/she received therectified contract.(3) If the contract lapses due to the buyer having invoked its non-bindingness, theseller shall without delay return the payments that he has received and refundthe buyer for the amount of the payments made under section 14. The returnedamounts shall bear interest, at the rate referred to in section 3(2) of the Interest<strong>Act</strong> (633/1982), as from the date when the payment had been received.Section 10 — Buyer’s right to withdraw from the contract (1162/1997)The buyer shall have the right to withdraw from the contract within ten days ofthe date when both parties had signed the contract.Subsection 2 has been repealed.Section 11 — Notice of withdrawal (1162/1997)The buyer shall give written notice of the withdrawal to the seller or to the personwhose name and address have been supplied for this purpose in the marketingdocument. The notice may be given in the language in which the contract wasdrafted under section 6(2).Subsection 2 has been repealed.Section 12 — Termination of a credit contract (1162/1997)If, for purposes of the sale, the buyer has been extended credit by the seller or byanother person on the basis of an agreement with the seller or anotherarrangement for the provision of consumer credit, the credit contract shall beterminated if the buyer withdraws from the contract. The credit contract shall belikewise terminated if the contract of sale lapses under section 9. Upon the78
