standard basis, shall be valid if the compensation under the contract isreasonable taking into account the loss generally incurred through withdrawal orcancellation and the provisions of paragraphs (1)—(3).Section 31 — Failure of the commissioner to co-operate (16/1994)(1) If the delivery of the elements is delayed due to a reason attributable to thecommissioner, the contractor shall be entitled to compensation from thecommissioner for costs of transport, storage and protection of the elements, aswell as insurance costs, made necessary because of the delay. A contract underwhich the compensation payable by the commissioner is determinedformulaically as a certain proportion of the price, or on another standard basis,shall be valid if the compensation under the contract is reasonable taking intoaccount the costs generally incurred by the contractor in a delay referred toabove.(2) If the installation of the elements is included in the obligations of the contractorand if the installation is delayed due to reasons attributable to the commissioner,the contractor shall be entitled to reasonable compensation for any loss that heincurs because no replacement work can be offered for the personnel allocatedfor the installation.(3) If the delivery referred to in section 1(1)(3) is delayed due to reasons attributableto the commissioner, the contractor shall be entitled to compensation in accordancewith paragraphs (1) and (2).(4) If the delivery of the contractor is unreasonably delayed due to a reasonattributable to the commissioner, the contractor shall be entitled to cancel thecontract and to obtain compensation from the commissioner in accordance withsection 30. If the installation of the elements is included in the obligations of thecontractor, the contractor shall, for this part, have a corresponding right tocancel the contract and the right to compensation.Other provisions on the sale of building elements and on construction projectsSection 32 — Application of the provisions of the Sale of Goods <strong>Act</strong> (16/1994)The provisions of the Sale of Goods <strong>Act</strong> apply to the sale of elements referred toin this chapter unless otherwise provided in this <strong>Act</strong>. The sale of elementsreferred to in this chapter is not governed by the provisions in sections 13(3), 31,47, 49(3) and 73(2) of the Sale of Goods <strong>Act</strong>.
