(2) If the time-share housing is located in a member state of the European EconomicArea (EEA state), but the contract would be subject to the law of a non-EEAstate, the provisions of this chapter nevertheless apply in so far as they offermore effective consumer protection than the law that would otherwise apply.Section 3 — Marketing document (1162/1997)The business shall draw up a specific document concerning a time-share object(marketing document), containing the information referred to in section 4 andexplaining how the consumer can obtain additional information. When marketingtime-share housing, the document shall be referred to and the consumers shallbe informed of where and how to obtain such a document.Section 4 — Information in a marketing document (1162/1997)(1) A marketing document shall contain at least the following information:(1) the name and address of the seller and, if the seller is not the owner of thetime-share object, the name and address of the owner, as well as anexplanation of the legal status and relationship of the seller and the owner;(2) an account of the characteristics of the time-share right and the conditionsfor the exercise of that right in the state where the time-share object islocated and, if these conditions have not been fulfilled, an account of thatpart of the conditions that remains unfulfilled;(3) a detailed account of the time-share object and the available housing, aswell as information on the location of the object;(4) information on common rooms and services included in the contract oravailable for inclusion therein, as well as on the conditions for their use;(5) an account of how the maintenance, administration and management of theobject has been arranged;(6) information on the selling prices, an estimate on the costs of use of thecommon rooms and services, as well as information on the bases for thecalculation of the costs, such as fees and statutory charges, that arise fromthe ownership and use of the time-share right;(7) an account of whether the object belongs to an exchange or resalearrangement, the administrator of the arrangement and the costs to theconsumer for making use of the arrangement;75
