(2) The right to sell a piece of property subject to the right of retention shall begoverned by special provisions thereon.Other provisions on certain consumer service contractsSection 32 — Property damage caused in connection with a service (16/1994)(1) If the object of the service or other property of the commissioner or his familymember has been damaged, diminished, destroyed or lost while in the possessionor under the supervision of the contractor under a service contract, thecontractor shall be liable to compensate for the loss unless he proves that theloss was not due to negligence on his part.(2) The obligation of the contractor to look after the service object shall not cease onthe basis of the cancellation of the contract until the object has been returned tothe possession of the commissioner or until the contractor, in accordance withprovisions elsewhere in the law, is entitled to stop looking after it.Section 33 — Mitigation of damage and adjustment of compensation (16/1994)The provisions of chapter 5, section 30 apply correspondingly to a servicereferred to in this chapter.Section 34 — Liability of the supplier of materials for defects (16/1994)(1) The commissioner shall be entitled to direct his claim, caused by a defect in thematerial used in the provision of a service and based on this chapter, alsoagainst the business who has delivered the material for sale at a previous level ofthe supply chain.(2) The commissioner shall, however, not have the right referred to in paragraph (1):(1) if the defect has been caused for reasons not attributable to the materialsupplier after he delivered the material on;(2) to the extent that the claim is based on another commitment than onemade by the supplier of the material, which places the commissioner in abetter position than he would be in by the provisions of this chapter withoutthe said commitment; nor(3) to the extent that the claim relates to a demand of price reduction or refundof the price of the service and exceeds the amount that the counterparty ofthe material supplier under the contract could have demanded on the samebasis, any restrictive terms in their contract disregarded.59
