5. Migration policy, legislation and procedures – present situation<br />
and planned <strong>migration</strong> management strategy<br />
5.1. Legal Background and Control <strong>of</strong> Migration in Republic <strong>of</strong> <strong>Bulgaria</strong><br />
As far as the international legal regulation <strong>of</strong> im<strong>migration</strong> control is concerned, the<br />
Republic <strong>of</strong> <strong>Bulgaria</strong> provides legal guarantees that these rules are effectively<br />
implemented. <strong>The</strong> basic ground is the principle enshrined in the Constitution <strong>of</strong> the<br />
country according to which: “Any international instruments which have been ratified by<br />
the constitutionally established procedure, promulgated and having come into force<br />
with respect to the Republic <strong>of</strong> <strong>Bulgaria</strong>, shall be considered part <strong>of</strong> the domestic<br />
legislation <strong>of</strong> the country. <strong>The</strong>y shall supersede any domestic legislation stipulating<br />
otherwise”.<br />
National legislation plays an important role in the defence <strong>of</strong> the foreigners’<br />
fundamental rights and freedoms. Mere incorporation <strong>of</strong> international law in the<br />
domestic legislation is not enough to provide the necessary guarantees. A wellelaborated<br />
process <strong>of</strong> creation and adoption <strong>of</strong> legal rules is necessary to reflect the<br />
specific national conditions and the democratic spirit <strong>of</strong> the international protection <strong>of</strong><br />
human rights.<br />
<strong>The</strong> basic rules with regard to the foreigners in <strong>Bulgaria</strong> can be found mainly in the<br />
domestic legislation. <strong>The</strong>re are two types <strong>of</strong> existing statutes – general and special.<br />
Domestic statutes <strong>of</strong> general nature contain only some general rules concerning the<br />
conduct <strong>of</strong> the foreigners on the territory <strong>of</strong> the Republic <strong>of</strong> <strong>Bulgaria</strong>.<br />
Until 1989 the terms and conditions under which foreigners could enter and stay in<br />
<strong>Bulgaria</strong>, and the specific rules on granting refugee status and right to asylum, were<br />
extremely strict. <strong>The</strong> development <strong>of</strong> <strong>social</strong> and political life in the following years made<br />
it possible to change the system <strong>of</strong> the organisation <strong>of</strong> society. <strong>The</strong> legislation became<br />
more liberal, even excessively liberal in certain aspects, and that created difficulties for<br />
the control <strong>of</strong> the foreigners in the country.<br />
<strong>The</strong> new <strong>migration</strong> policy <strong>of</strong> <strong>Bulgaria</strong> seeks optimal balance between freedom <strong>of</strong><br />
movement <strong>of</strong> people and illegal im<strong>migration</strong> control, combined with respect for<br />
fundamental human rights and freedoms.<br />
A series <strong>of</strong> measures was undertaken to improve <strong>migration</strong> legislation and policy.<br />
<strong>The</strong> <strong>Bulgaria</strong>n Citizenship Act <strong>of</strong> 18 November 1998 regulates the procedure for<br />
acquisition, restoration and loss <strong>of</strong> <strong>Bulgaria</strong>n citizenship. It resolves the issue <strong>of</strong> dual<br />
citizenship as well. <strong>The</strong> statute represents the legal ground for adoption <strong>of</strong> the<br />
Foreigners in the Republic <strong>of</strong> <strong>Bulgaria</strong> Act, <strong>Bulgaria</strong>n Identity Documents Act, Civil<br />
Registration Act, Administrative Services for Natural Persons and Legal Entities Act.<br />
<strong>The</strong> <strong>Bulgaria</strong>n Identity Documents Act <strong>of</strong> 11 August 1998, in force since 1 April 1999,<br />
introduced procedures and conditions for the issuance, usage and safekeeping <strong>of</strong><br />
