At the same time, attempts are made to sign agreements for <strong>social</strong> insurance with those<br />
countries so that this type <strong>of</strong> relationships be regulated as well and <strong>Bulgaria</strong>n citizens<br />
be able to accumulate points towards their pensions or other periods <strong>of</strong> time. In case<br />
<strong>Bulgaria</strong> does not have an agreement for <strong>social</strong> insurance with the respective country,<br />
a special article is included in the labour agreement stating the intention <strong>of</strong> the<br />
countries to do that. <strong>The</strong> best solution at this stage is to sign a package <strong>of</strong> 3 agreements<br />
with the member states, namely for employment, <strong>social</strong> insurance, and readmission.<br />
<strong>Bulgaria</strong> has already signed readmission agreements with all <strong>of</strong> the EU member states.<br />
In issue No 49 <strong>of</strong> the State Gazette from May 2003, there has been published the new<br />
Ordinance for the Conditions and Order for Executing Consultancy for Securing<br />
Employment, which was adopted by the Council <strong>of</strong> Ministers. <strong>The</strong> Ordinance lists the<br />
conditions and order for executing consultancy for securing employment in the<br />
Republic <strong>of</strong> <strong>Bulgaria</strong> and other countries, as well as <strong>of</strong> marine workers, for registration<br />
for executing consultancy, its rejection and suspension, the maximum amount <strong>of</strong> the<br />
price <strong>of</strong> the consultancy service, paid by the hired persons, and the obligatory<br />
requirements for the contents <strong>of</strong> the consultants' contracts.<br />
Changes had occurred in the following directions:<br />
• Easing <strong>of</strong> the regime for executing consultancy for finding employment through its<br />
transformation from a permissive to a registering one. <strong>The</strong> expiry date <strong>of</strong> the<br />
registration has been extended from 2 to 3 years.<br />
• Registration in the Agency for Employment <strong>of</strong> all contracts signed between the<br />
consultant and the foreign employer, including the ship-owner (operator). <strong>The</strong><br />
contracts between the employer and the hired person are not registered in the<br />
Agency for Employment.<br />
• Gathering <strong>of</strong> information during 3 months about the hired persons on indicators<br />
approved by the executive director <strong>of</strong> the Agency for Employment.<br />
<strong>The</strong> expected results from the change and elaboration <strong>of</strong> the conditions and order for<br />
executing consultancy for finding employment are the following: easing <strong>of</strong> the<br />
procedure at the start <strong>of</strong> the activity, improvement <strong>of</strong> the quality <strong>of</strong> the consultancy<br />
services <strong>of</strong>fered, raising the efficiency <strong>of</strong> the control and monitoring <strong>of</strong> the consultants'<br />
work.<br />
5.3. Conclusions<br />
Regulation <strong>of</strong> <strong>migration</strong> processes is already harmonized with international norms and the<br />
acquis communautaire; nearly all the recommendations for adjusting the <strong>Bulgaria</strong>n<br />
legislation to contemporary legal norms have been fulfilled. <strong>The</strong> management and control<br />
<strong>of</strong> <strong>migration</strong> processes are a key priority <strong>of</strong> the <strong>Bulgaria</strong>n government. <strong>The</strong> main<br />
objective is to increase the feeling <strong>of</strong> security <strong>of</strong> the citizens in their own country,<br />
thereby decreasing their desire for e<strong>migration</strong> while adopting efficient measures to stop<br />
illegal im<strong>migration</strong>.
