3. Measures regarding labour im<strong>migration</strong> – adopted to protect the <strong>Bulgaria</strong>n labour<br />

market:<br />

• Amendments in the legislation regarding the admittance <strong>of</strong> foreigners as employees –<br />

a permit regime has been adopted since 1994;<br />

• Adopting legislation for the admittance <strong>of</strong> foreigners as freelance individuals – a<br />

separate permit regime is being introduced;<br />

• At the same time – ensuring the equal treatment <strong>of</strong> those foreign workers who have<br />

been admitted to the <strong>Bulgaria</strong>n market. In this area, the criteria <strong>of</strong> EU legislation and<br />

the requirements <strong>of</strong> other international organisations have been covered.<br />

In addition, <strong>Bulgaria</strong> is observing and adopting in its legislation the various<br />

requirements <strong>of</strong> the EU regarding the citizens <strong>of</strong> member states and the citizens <strong>of</strong> third<br />

countries for work-related stay, for access to the labour market, for labour permission<br />

for the families <strong>of</strong> workers who have already been admitted.<br />

On the other hand, <strong>Bulgaria</strong> is adhering strictly to the equal treatment <strong>of</strong> those<br />

foreigners who have already been hired, regarding work conditions, payment, holidays,<br />

dismissal, etc. This also applies to foreigners on business trips.<br />

<strong>The</strong> Constitution <strong>of</strong> the Republic <strong>of</strong> <strong>Bulgaria</strong> and its national legislation are based on the<br />

principle <strong>of</strong> non-discrimination as provided by article 6 <strong>of</strong> the Constitution. <strong>The</strong> rights<br />

stipulated in the legislation do not refer to certain groups based on a certain<br />

characteristic, but to all citizens under the jurisdiction <strong>of</strong> the country. It means that the<br />

<strong>Bulgaria</strong>n legislation recognises the individual rights and freedoms <strong>of</strong> all persons<br />

without any restrictions based on nationality, ethnic origin, race, sex, religion,<br />

education, political and other affiliation, personal, public or property status.<br />

5.2.2. Admission <strong>of</strong> third-country nationals for paid employment<br />

<strong>The</strong> admission <strong>of</strong> foreign nationals for paid-employment and for self-employment is<br />

treated separately - in conformity with requirements <strong>of</strong> the EU acquis.<br />

<strong>The</strong> admission is regulated in the following legal instruments:<br />

• Foreign Nationals Act;<br />

• Employment Promotion Act – Chapter Eight;<br />

• Regulation on the terms and procedures for issuance, denial and suspension <strong>of</strong><br />

foreign nationals’ work permits in the Republic <strong>of</strong> <strong>Bulgaria</strong> (SG No. 39/16.04.2002, in<br />

force from 17.06.2002)<br />

A new Employment Promotion Act has been adopted; it has been in force since<br />

01.01.2002. According to the new Employment Promotion Act, the Employment Agency is<br />

established under the minister <strong>of</strong> labour and <strong>social</strong> policy for the purposes <strong>of</strong><br />
